ANDHRA PRADESH (TELANGANA AREA) FAMINE STRICKEN PATTADARS PROPERTY PROTECTION ACT, 1331

Whereas it is expedient to protect immovable property of the famine stricken pattadars to a certain extent; It is hereby enacted as follows:-
Section 1 Short title, commencement and extent
(1) This Act may be called `The A.P. (T.A.) Famine-Stricken Pattadars Property Protection Act'.
(2) This Act shall come into force in such places as the Government may specify by notification in the Jarida.
(3) This Act shall apply to the transfers made after such date as the Government may have specified by notification in the jarida.
(4) Where the Government by a notification in the Jarida declare that a place has ceased to be famine-stricken, this Act shall not apply to the transfers made after the date of such declaration.
Section 2 Definitions
Unless there is anything repugnant in the subject or context,-
(1) `Pattadar' includes a shikmipattadar and also includes a person having right of occupancy of a revenue land;
(2) `Property' means the right of occupancy of a revenue land and it shall include a dwelling and farm-house with land appertaining thereto
Section 3 Right of pattadar to claim return of property sold on payment of sum
(1) Where a Pattadar has sold a property during the dates notified under sub-sections (3) and (4) of Section I, he shall have the right within three years from the date whence it no longer remained a famine stricken place to deposit the sale proceeds together with 5 per cent thereof and claim to return the property sold.
(2) When a claim is made under sub-section (1), the court shall send a notice to the defendant and after giving a hearing to him an order shall be passed for the return of the property.
Section 4 Relief in case of execution of decree against famine - stricken pattadar
When a place is declared famine-stricken under Section I and an application for the execution of a decree is filed against the pattadar the Court shall refuse to execute the decree against such movable and immovable property of the pattadar as the court, may in view of the conditions of the pattadar, think proper. |
