KARNATAKA PRIVATE MEDICAL COLLEGES (PROHIBITION OF CAPITATION FEES, FIXATION OF INTAKE AND ALLOCATION OF SEATS AMONG DIFFERENT CATEGORIES, ETC.) RULES, 1984

In exercise of the powers conferred by Sections 3, 4, 5 and 14 of the Karnataka Educational Institutions (Prohibition of Capitation Fee) Ordinance, 1984 (Karnataka Ordinance No. 8 of 1984) and all other powers enabling thereto, the Government of Karnataka hereby make the following rules to govern the charging of capitation fees and fixation of intake of students, and to regulate the selection, admission and distribution of various categories of seats in respect of the Private Medical Colleges in the State, namely:
Section 1 Short title and commencement
(1) These rules shall be called the Karnataka Private Medical Colleges (Prohibition of Capitation Fees, Fixation of Intake and Allocation of Seats Among Different Categories, Etc.) Rules, 1984.
(2) They shall come into force from the academic year 1984-85 and onwards.
Section 2 Permission to collect capitation fees/deposits
The managements of Private Medical Colleges in the State established prior to the Eleventh day of July, 1983, which were charging capitation fees for the admission of all or any of the students to I MBBS Course during the academic year 1983-84 may, if such institutions are maintained solely or substantially out of amounts collected as capitation fee, continue to collect such fee in respect of seats specified in Column 4 of the Table under sub-rule (1) of Rule 4, at a rate not exceeding Rupee one and a half lakhs per student for students who are not foreign students or non-resident Indians and not exceeding Rupees two lakhs per student in any other case for a maximum period of five academic years from the said date. Such colleges may also collect cash deposits not exceeding Rupees fifty thousand per seat in respect of the seats specified in Column 3 of the said Table, subject to the refund of such deposits without interest to the students concerned, at the end of a period of ten years.
Section 3 Fixation of intake of students into Private Medical Colleges in the State
The annual intake of students for the various Private Medical Colleges in the State is fixed as follows.
Section 4 Allocation of seats among different categories
(1) The distribution of I MBBS seats among different categories of students, in the following Private Medical Colleges in the State, which were charging capitation fees for admission to the I MBBS Course in respect of some or all the seats during the academic year 1983-84 shall be as specified in the Table below, for the year 1984-85.

(2) The number of foreign students/non-resident Indian students admitted in each college, shall not exceed twenty per cent of the total number of seats available, in the college against the capitation fees quota mentioned in Column 4 of sub-rule (1).
(3) In the case of the Government seats in M.R. Medical College, Gulbarga, twenty per cent of the merit seats shown in Column 2 of the said table (i.e., a total of 10 seats) shall be filled from amongst candidates who have passed their qualifying examination from institutions located within the jurisdiction of Gulbarga University.
Section 5 Regulation of Tuition Fees
No Private Medical College in the State shall collect any tuition fees exceeding a sum of Rupees five thousand per annum per student from any category of students admitted to that college.
Section 6 Eligibility
(1) The eligibility of candidates for admission to the First MBBS Course shall be as specified in Rule 3 of the Karnataka Medical Colleges (Selection of candidates for admission) Rules, 1984 (hereinafter referred to as the aforementioned rules):
Provided that sub-clause (b) of clause (4) and the provisos to Rule 3 of the aforementioned rules shall not be applicable in respect of the admission of candidates to the category of seats specified in Column 3 of the Table under sub-rue (1) of Rule 4:
Provided further that clause (3), sub-clause (b) of clause (4) and the provisos to Rule 3 of the aforementioned rules shall not be applicable in respect of the admission of candidates other than foreign nationals or non-resident Indians to the category of seats specified in column (4) of the Table under sub-rule (1) of Rule 4:
Provided also that clauses (1) and (3), sub-clause (b) of clause (4) and the proviso to Rule 3 of the aforementioned rules shall not be applicable in respect of admission of foreign Nationals or Non-resident Indians to the category of seats specified in Column 4 of the said Table under sub-rule (1) of Rule 4.
(2) No foreign student shall be admitted by any college unless he obtains and produces the eligibility certificate issued by the University concerned to the effect that be fulfills the requirements of eligibility as provided under these rules.
Section 7 Procedure for admissions
(1) The seats indicated in Column 2 of the table in sub-rule (1) of Rule 4 shall be filled under and in accordance with the Karnataka Medical Colleges (Selection of candidates for admission) Rules, 1984 by the Selection Committee constituted thereunder.
(2) The seats specified in Column 3 of the Table under sub-rule (1) of Rule 4 shall be filled by the management of the concerned Private Medical Colleges by constituting Selection Committees, which however shall have one representative each of the State Government and of the concerned University as members. The selections in respect of these seats shall be on the basis of merit from amongst the candidates who apply for admission to I MBBS Course under this category in that particular College, such candidates need not pay the deposit of Rs. fifty thousand along with their application but shall be required to deposit this sum with the college management after selection at the time of admission.
(3) The seats specified in Column 4 of the Table under sub-rule (1) of Rule 4 may be filled up by the management of the concerned Private Medical College at their discretion, subject to fulfilment of the eligibility requirements and the observance of other provisions of these rules.
Section 8 Maintenance of accounts
Every Medical College shall maintain proper accounts of all the items of its receipts and expenditure and utilisation of moneys received or collected by it only for the maintenance/development of the medical college, including provision of teaching/clinical facilities. It shall not divert the funds received/collected as above for any purpose other than those mentioned hereabove. |
