KARNATAKA PARLIAMENTARY SECRETARIES SALARY, ALLOWANCES AND MISCELLANEOUS PROVISIONS ACT, 1963

An Act to provide for the salary, allowances and miscellaneous provisions of Parliamentary Secretaries. Whereas, it is expedient to provide for the 2[salary, allowances and miscellaneous provisions] of Parliamentary Secretaries of the State of Karnataka; Be it enacted by the Karnataka State Legislature in the Fourteenth Year of the Republic of India as follows.


 


Section 1 Short title and commencement


 


(1) This Act may be called the Karnataka Parliamentary Secretaries 33. Substituted for the word "Allowances" by Act No. 7 of 1999 and shall be deemed to have come into force w.e.f. 12-3-1999 [Salary, Allowances and Miscellaneous Provisions] Act, 1963.


 


(2) It shall come into force at once.


 


Section 2 Definitions


 


In this Act, unless the context, otherwise requires.


 


(a) "Parliamentary Secretary" means a member of the Karnataka Legislative Assembly or the Karnataka Legislative Council appointed as a Parliamentary Secretary 44. Inserted by Act No. 7 of 1999 and shall be deemed to have come into force w.e.f. 12-3-1999 [by the Chief Minister];


 


(b) "Prescribed" means prescribed by rules made under this Act;


 


55. Clause (c) omitted by Act No. 7 of 1999 and shall be deemed to have come into force w.e.f. 12-3-1999 [(c) "Residence" x x x x x.]


 


Section 3 Salary and allowances of Parliamentary Secretary


 


66. Sections 3 to 6 substituted by Act No. 7 of 1999 and shall be deemed to have come into force w.e.f. 12-3-1999 [A Parliamentary Secretary shall be entitled to such salaries and allowances as are admissible to a Minister, Minister of State or a Deputy Minister under the Karnataka Minister's Salaries and Allowances Act, 1956, as may be specified by the Government from time to time.


 


Section 4 Parliamentary Secretary not to draw salaries and allowances as member


 


A Parliamentary Secretary shall not, while he draws salary and allowances for his office, be entitled to any salary and allowances as a member of a Legislative Assembly or Legislative Council, as the case may be.


 


Section 5 Functions and duties of Parliamentary Secretary


 


The functions and duties of a Parliamentary Secretary shall be such as may be specified by the Chief Minister or a Minister to whom he is the Parliamentary Secretary.


 


Section 6 Oath of office and of secrecy


 


Before a Parliamentary Secretary enters upon his office, the Chief Minister shall administer to him the oath of office and of secrecy according to such form as may be specified by the Government in this behalf.]


 


Section 7 Parliamentary Secretary not to practice profession, etc


 


A Parliamentary Secretary shall not, during the tenure of his office, practice any profession or engage in any trade or undertake for remuneration, any employment other than his duties as Parliamentary Secretary.


 


Section 8 Power to make rules


 


(1) The State Government may, by notification in the Karnataka Gazette, make rules for carrying out the purposes of this Act.


 


(2) Every rule made under this section shall be laid as soon as may be after it is made, before each House of the State Legislature while it is in session for a total period of thirty days which may be comprised in one session or in two successive sessions, and if, before the expiry of the session in which it is so laid or the session immediately following, both Houses agree in making any modification in the rule or both Houses agree that the rule should not be made, the rule shall thereafter have effect only in such modified form or be of no effect, as the case may be; so however that any such modification or annulment shall be without prejudice to the validity of anything done under that rule.


 


RULE:


 


KARNATAKA PARLIAMENTARY SECRETARIES (TRAVELLING ALLOWANCES) RULES, 1965


 


In exercise of the powers conferred by Section 8 of the Karnataka Parliamentary Secretaries Allowances Act, 1963 (Karnataka Act 15 of 1963), the Government of Karnataka hereby makes the following rules, namely.


 


Rule 1 Title


 


These rules may be called the Karnataka Parliamentary Secretaries (Travelling Allowances) Rules, 1965.


 


Rule 2 Definitions


 


In these rules, unless the context otherwise requires.


(a) "Advance" means a repayable advance made to a Parliamentary Secretary on account of travelling and daily allowance;


 


(b) "Day" means a calendar day beginning and ending at midnight; but an absence from Headquarters which does not exceed twenty-four hours shall be reckoned for all purposes as one day, at whatever hour the absence begins or ends.


 


Rule 3 Reimbursement of certain deductions


 


On the cancellation of a journey due to official reasons or due to circumstances which were unavoidable and beyond the control of the Parliamentary Secretary, he shall be entitled to be reimbursed by Government, any deductions made by an Air Transport or Railway authority when refunding the fare on account of the cancellation of air passage or the railway journey respectively.


 


Rule 4 Payment of advance travelling and daily allowances


 


(1) A Parliamentary Secretary shall be entitled to an advance of travelling and daily allowance in respect of tours undertaken by him in the discharge of his official duties, whether by road, rail or air.


 


(2) An advance drawn shall be adjusted in the appropriate travelling allowance bill before the end of the month following the month in which the advance is drawn.


 


Rule 5 Use of Government Vehicles


 


Whenever a Parliamentary Secretary uses in the public interest a Government Department vehicle, including a vehicle maintained for guests by a Government Guest House, he shall be entitled, at his option, to use the vehicle and pay the full charges prescribed for the use of Government vehicles and draw daily allowance and road mileage for the days on which the vehicle is so used or to use the vehicle free of all charges, and in such a case, he shall not be entitled to road mileage but shall be entitled to draw daily allowance for the days on which the vehicle is so used.


 


Rule 6 Accommodation in Travellers' Bungalows, etc


 


A Parliamentary Secretary shall while on tour on duty, be entitled to accommodation in Travellers' Bungalows or Guest Houses maintained by Government on payment of rent at such rates as are applicable to a Government servant of the highest class occupying such accommodation.


 


Rule 7 Insurance for air travel


 


11. Rule 7 omitted by GSR 118, dated 20/22-3-1968, w.e.f. 25-4-1968 [x x x x x.]


 


Explanation Claim for insurance premium for air journeys should be supported by the receipts or policies issued by the Insurance Companies.


 


Rule 8 Concessional rates to be utilised


 


The concessional rates allowed by Air Transport or Railway authorities, shall be availed of by a Parliamentary Secretary if the return journey is expected to be performed within the period during which a return ticket is available.


 


Rule 9 Controlling Officer


 


A Parliamentary Secretary shall be his own Controlling Officer. The signature of a Parliamentary Secretary on his travelling allowance bill (or on the railway requisition) shall be accepted as an authority for the journey, without requiring any further orders of Government.


 


Rule 10 Payment after pre-audit


 


All sums due from Government to a Parliamentary Secretary which are outstanding on the day on which he relinquishes office, shall be paid to the Parliamentary Secretary after pre-audit by the Accountant General.


 


Rule 11 Application of Karnataka Civil Services Rules


 


(1) In respect of any matter for which no specific provision has been made in these rules, the provisions contained in Part VIII of the Karnataka Civil Services Rules governing the payment of travelling allowance to a Class I Officer of the State Civil Service drawing a pay of one thousand and two hundred rupees or more per mensem shall, mutatis mutandis, be applicable to a Parliamentary Secretary.


 


(2) If any question arises regarding the applicability of any rule referred to in sub-rule (1) to a Parliamentary Secretary, it shall be referred to the State Government, and the decision of the State Government thereon shall be final.


 


KARNATAKA RESIDENCES OF PARLIAMENTARY SECRETARIES (FURNISHING) RULES, 1963


 


In exercise of the powers conferred by sub-section (1) of Section 8 of the Karnataka Parliamentary Secretaries Allowances Act, 1963 (Karnataka Act 15 of 1963), the Government of Karnataka hereby makes the following rules, namely.


 


Rule 1


 


(i) These rules may be called the Karnataka Residences of Parliamentary Secretaries (Furnishing) Rules, 1963.


 


(ii) They shall be deemed to have come into force on the 20th day of April, 1963.


 


Rule 2


 


The residence of a Parliamentary Secretary provided under sub-section (1) of S.3 of the Karnataka Parliamentary Secretaries Allowances Act, 1963 shall be furnished in the following scales, namely.


I. Furniture


 


(a) Drawing Room or Reception Room.


(i) Two sofa sets of three pieces each;


(ii) Two chairs;


(iii) One central table;


(iv) Two teapoys;


(v) One carpet.


 


(b) Dining Room.


(i) One dining table;


(ii) Eight chairs;


(iii) One side board or dinner wagon.


 


(c) Bed Room (Maximum of two bed rooms to be furnished). Per bed room,


(i) Two cots with mattresses and pillows;


(ii) One wardrobe;


(iii) One coatstand;


(iv) One chest of drawers;


(v) One dressing table;


(vi) Two side tables;


(vii) One carpet;


(viii) One extra almirah in one bed room and one extra cot with mattress and pillow.


 


(d) Office Room.


(i) One office table;


(ii) One book case;


(iii)One office chair.


 


 


II. Linen


 


(i) Door and window curtains;


(ii) Mosquito curtains one per bed;


 


III. Crockery and Cutlery.


 


(i) Eight cups and saucers;


(ii) Two tea pots;


(iii) Two sugar basins;


(iv) Two milk jugs;


(v) Two tea trays;


(vi) Dinner set for eight persons either of crockery in Indian style or of stainless steel.


 


IV. Miscellaneous


 


(i) One radio;


(ii) One wall clock;


(iii) Eight chairs partly cane and partly wooden for office;


(iv) One hat stand with mirror for the verandah;


(v) One meat safe;


(vi) One hot case;


(vii) Two durries (cotton carpets).


 


Rule 3


 


Each Parliamentary Secretary may purchase at Government cost and with the sanction of the State Government miscellaneous items of articles required for furnishing the residence, provided that the expenditure on this account shall not exceed three hundred rupees during the period he holds the office of the Parliamentary Secretary and resides in such residence. Such articles shall be Government property and form part of the furniture provided for the residence.


 


Rule 4


 


The three rooms in the residence of a Parliamentary Secretary referred to in sub-section (2) of S.3 of the Karnataka Parliamentary Secretaries Allowances Act, 1963 shall be furnished on the following scale.


I. Office Room


 


(i) One office table;


(ii) One office chair;


(iii) One book case;


(iv) Three chairs;


(v) One carpet.


 


II. Drawing Room or Reception Room


 


(i) One carpet;


(ii) One wall clock;


(iii) One sofa set;


(iv) Two teapoys;


(v) One central table.


 


III. Extra Room


 


(i) One carpet;


(ii) One small office table;


(iii) One teapoy;


(iv) Four chairs cane or wooden;


(v) Two foot rugs;


(vi) Four door and window curtains;


(vii) Four table cloths.


 


Rule 5


 


(1) The articles with which a residence of a Parliamentary Secretary is furnished under Rule 2 and Rule 3 and the articles with which the rooms in the residence of a Parliamentary Secretary are furnished under Rule 4 shall be deemed to be articles in charge of the Parliamentary Secretary concerned, and a list of such articles shall be maintained by the State Government and a duplicate copy of such list maintained by the Personal Assistant to the Parliamentary Secretary.


 


(2)


 


(a) Whenever a residence furnished under Rule 2 and Rule 3 is vacated by a Parliamentary Secretary on relinquishing office, the articles with which such residence had been furnished shall be delivered by the Parliamentary Secretary concerned to the State Government along with the list of articles maintained by the Personal Assistant to the Parliamentary Secretary.


(b) The articles with which the rooms in the residence of a Parliamentary Secretary are furnished under Rule 4 shall be returned to the State Government when the Parliamentary Secretary concerned relinquishes his office along with the list of articles maintained by the Personal Assistant to the Parliamentary Secretary.


 


Rule 6


 


(1) All expenditure on maintenance of the articles provided under these rules in good condition and on repairs to such articles due to normal wear and tear shall be borne by the State Government.


 


(2) Losses in the articles provided under these rules due to breakages, thefts, or other causes may be written off by the Government provided that the value thereof does not exceed in the case of unbreakable articles, Rs. 50 and in the case of fragile articles, Rs. 100 per year.


 


(3) The linen and carpets provided under these rules, when unserviceable, may be replaced by the Government provided the unserviceable articles are returned to Government.
