STATEMENT OF OBJECTS AND REASONS KARNATAKA ACT No. 1 OF 1968 Karnataka Gazette, Extraordinary, dated 4-12-1967 It is considered that there is no need to defer elections to the several local authorities whose terms have expired but are continued by virtue of the provisions made in the Karnataka Local Authorities (Postponement of Elections and Continuance of Administrators) Act, 1965. The said Act is therefore proposed to be repealed.
An Act to repeal the Karnataka Local Authorities (Postponement of Elections and Continuance of Administrators) Act, 1965. Whereas, it is expedient to repeal the Karnataka Local Authorities (Postponement of Elections and Continuance of Administrators) Act, 1965 (Karnataka Act 24 of 1965); Be it enacted by the Karnataka State Legislature in the Eighteenth Year of the Republic of India as follows.
Section1 Short title and commencement
(1) This Act may be called the Karnataka Local Authorities (Postponement of Elections and Continuance of Administrators) (Repealing) Act, 1967.
(2) It shall come into force at once.
Section2 Interpretation
In this Act, the expressions "local authority" and "relevant Act" have the same meaning as in the Act repealed by Section 3.
Section3 Repeal of Karnataka Act 24 of 1965 and savings
The Karnataka Local Authorities (Postponement of Elections and Continuance of Administrators) Act, 1965 (Karnataka Act 24 of 1965) is hereby repealed:
Provided that notwithstanding the repeal of the said Act, and notwithstanding anything in any enactment by or under which any local authority is constituted or established.
(a) the term of office of the councillors or members extended by Section 3 of the Act now repealed and of the Administrators appointed or continued under Section 4 or 5 of the said Act, shall expire on such date as the State Government may by notification in the Official Gazette appoint in respect of each local authority concerned which shall not be a date later than one year from the date of commencement of this Act; but the councillors or members or, as the case may be, the Administrators shall continue in office until the first meeting of the local authority duly reconstituted under the relevant Act, at which a quorum is present;
(b) if any Advisory Council has been appointed under Section 6 of the said Act, it shall continue to function until the date appointed under clause (a); but the State Government may at any time after the commencement of this Act, by notification in the Official Gazette, dissolve any such Advisory Council.
Section4 Act not to affect certain notifications and orders
The provisions of this Act shall not affect or be deemed to affect the operation of any notification or order of supersession of any local authority made or issued after the 18th day of November, 1965, in accordance with the provisions of the relevant Act. |
