INDUSTRIAL DISPUTES (CHHATTISGARH AMENDMENT) ACT, 2015

[Received the assent of the Governor on the 31st March, 2015 and assent of the President on the 22nd July, 2015; assent first published in the Chhattisgarh Rajpatra (Asadharan) dated the 1st August, 2015.]

An Act further to amend the Industrial Disputes Act, 1947 (No. 14 of 1947) in its application to the State of Chhattisgarh.

Be it enacted by the Chhattisgarh Legislature in the Sixty-sixth Year of the Republic of India, as follows :-

1. Short title, extent and commencement. - (1) This Act may be called the Industrial Disputes (Chhattisgarh Amendment) Act, 2015.

(2) It shall extend to the whole State of Chhattisgarh.

(3) It shall come into force from the date of its publication in the Official Gazette.

2. Amendment of the Industrial Disputes Act, 1947 (Central Act No. 14 of 1947), in its application to the State of Chhattisgarh. - The Industrial Disputes Act, 1947 (No. 14 of 1947), (hereinafter referred to as the Principal Act), in its application to the State of Chhattisgarh be amended in the manner hereinafter provided.

3. Amendment of Section 2-A. - (1) In sub-section (3) of Section 2A of the Principal Act,-

(i) for the punctuation full stop the punctuation colon shall be substituted; and

(ii) below sub-section (3), the following shall be inserted, namely :- "Provided that when a dispute or difference is raised in conciliation proceeding, the period taken in such proceeding shall be excluded in calculating the period of three years.".

(2) After sub-section (3) of Section 2A of the Principal Act, the following shall be inserted, namely:-

"(4) Notwithstanding anything contained in sub-sections (1), (2) and (3) above, dispute or difference between the workman and his employer, connected with or arising out of discharge, dismissal, retrenchment or termination shall not be deemed to be an industrial dispute unless such dispute or difference is not raised in conciliation proceeding within a period of three years from the date of such discharge, dismissal, retrenchment or termination:

Provided that an authority, as may be specified by the State Government, may entertain such disputes or difference after the expiry of the said period of three years if it is satisfied that there was sufficient cause for not raising it within that period of three years.".

4. Amendment of Section 25N. - In sub-section (9) of Section 25N of the Principal Act, after the words "in excess of six months", the words "and an amount equivalent to his three months average pay" shall be inserted.

5. Amendment of Section 25O. - In sub-section (9) of Section 25O of the Principal Act, after the words "in excess of six months", the words "and an amount equivalent to his three months average pay" shall be inserted.
