UTTAR PRADESH STATE SPORTS UNIVERSITY ACT, 2021 (U.P. Act No. 8 of 2021) An Act to provide for the establishment of an affiliating and teaching University of Sports in the State and for matters connected therewith or incidental thereto. It Is Hereby enacted in the Seventy-second Year of the Republic of India as follows :- Chapter-1 Preliminary 1. Short title, extent and commencement. - (1) This Act may be called the Uttar Pradesh State Sports University Act, 2021. (2) It extends to the whole of the State of Uttar Pradesh. (3) It shall come into force on such date as the State Government may. by notification in the Gazette, appoint. Object & Reasons Statement of Objects and Reasons. - There is tremendous potential for development of sports in Uttar Pradesh. Students having a special interest and aptitude in sports and who wish to adopt it as a professional career in future not only need a conducive environment for development of sports culture and sports activities in the State, but also need to be given an option to choose sports as a career. In view of the above, it has been decided to establish a teaching and affiliating Sports University in the State of Uttar Pradesh to develop excellence in sports by providing practical-based education in sports related courses and its allied disciplines and to provide better training opportunities to emerging sports persons by establishing state-of-the art sports infrastructure and facilities in Uttar Pradesh. This would promote development of skills and physical aptitude sports persons to win medals in competitive events, and would also help in creation of employment opportunities for youth in the field of sports. The Uttar Pradesh State Sports University Bill, 2021 is introduced accordingly. 2. Definitions. - In this Act, unless the context otherwise requires.- (a) "Academic and Activity Council" means the Academic and Activity Council of the University constituted under section 24 of this Act; (b) "Act" means the Uttar Pradesh State Sports University Act. 2021 ; (c) "Affiliated college" means a college or institution affiliated by the University under section 28 of this Act; (d) "Associated Activity School/College " means any institution recognised by the University and authorised under the provisions of this Act including Uttar Pradesh Sports department's infrastructure. Uttar Pradesh Sports College Hostels having sports facilities for at least three indoor and two outdoor sports facilities for games recognized by the State Government within a radius of fifteen kms from the outermost boundary of the College seeking affiliation in order to fulfil the practical sessions as per the curriculum required; (e) "Board" means the Board of Governors of the University* constituted under section 20 of this Act; (f) "College" means a college or an institution teaching any of the courses leading to a degree or a diploma or a certificate etc. under this Act: (g) "Deans" means the Deans of the University appointed under section 15 of this Act; (h) "Directors" means the Director of the University appointed under section 14 of this Act; (i) "Employee" means any person appointed by the University and includes a teacher or any other member of the staff of the University; (j) "Faculty" means faculty of the University or College; (k) "Finance Committee" means the Finance Committee of the University constituted under section 26 of this Act; (I) "Hostel" means scholar/student hostel of the University or College; (m) "NAAC" means certification from National Assessment and Accreditation Council of India ; (n) "Registrar" means the Registrar of the University appointed under section 17 of this Act; (o) "Regulations" means the regulations of the University made under this Act; (p) "Regulatory Body" means the Statutory bodies established by the Central Government from time to time such as University Grams Commission and includes the All India Council for Technical Education, the Bar Council of India, the Distance Education Council, the Dental Council of India, the Indian Nursing Council, the Medical Council of India, the National Council for Teacher Education. Central Council for Indian Medicine, the Pharmacy Council of India etc.; (q) "Statutes " and "Ordinances" means the Statutes and the Ordinances of the University for the time being in force ; (r) "Student" means a student enrolled in the register of the University or College Associated or Affiliated to the University; (s) "Teacher of the University" means Professors, Associate Professors, Assistant Professors, coaches and such other persons as may be appointed for imparting instructions, coaching, training or conducting research in the University, College or Institution and Study Centres maintained by the University and are designated as teachers by the Statutes; (t) "Vice-Chancellor" means the Vice-Chancellor of the University appointed under section 12: (u) "University Grants Commission" means University Grants Commission established under section 4 of the University Grants Commission Act, 1956; (v) "Study Centre" means a centre established, maintained or recognised by the University for the purpose of advising, counselling, coaching, training or for rendering any other assistance required by the students: (w) "University" means the University established and incorporated under section 3 of this Act. Chapter - II University 3. Establishment and Incorporation of the University. - (1) There shall be established a University by the name of the" [Major Dhyanthand Sports University]". (2) The Vice-Chancellor, the Board, the Academic and Activity Council, the Directors, the Deans, the Registrar and all other persons who may hereafter become such officers or members so long as they continue to hold such office or membership, shall constitute a University by the name of the "Uttar Pradesh State Sports University". (3) The University shall be a body corporate by the name as aforesaid, having perpetual succession and common seal with power, subject to the provisions of this Act. to acquire and hold property, to contract and shall, by the said name, sue or be sued. (4) In all suits and other legal proceedings by or against the University, the pleadings shall be signed and verified by the Registrar and all processes in such proceedings shall be issued to, and served on the Registrar. (5) The University shall function as an affiliating and teaching University and it shall affiliate any college or institution for teaching or coaching students leading to the conferment of degrees, diplomas, or grant certificates for skill development and vocational purpose to the students admitted therein. Post graduate studies and research will also be undertaken. 4. Headquarters of the University. - The headquarters of the University shall be in Meerut district. 5. Objects of the University. - The objects of the University shall be, - (i) to provide an academic and professional development career pathway for young persons with physical aptitude and persons who are desirous of pursuing sports as a profession and devote their entire career to an Olympic recognised sports to reach national and international standards and win medals for India and continue in the profession by becoming a coach, manager or sports professional; (ii) to develop sports persons meeting physical and skill standards by inculcating an attitude of continuous performance enhancement as per national and international standards by providing especially designed sports skills development and academic inputs in various areas of sports education, sports sciences and also incorporating advanced sports technologies for sports in sports persons and coaches; (iii) to assist sports persons to acquire a Bachelor's Degree along with their career in sports. University will run Bachelor of Sports (three year Degree Course) with specialization in one of the Olympic recognised team/individual sports, focusing on Athletics. Hockey. Wrestling and Boxing, Volleyball, Basketball, Football, Handball, where the evaluation of the Bachelor's Degree will be based on participation and winning medals in the National University Games. National Games and International Sports Competitions: (iv) to establish Specialized Centres and Institutions of Excellence focusing on specific sports discipline for imparting state of the art educational training and research in the fields of sports and sports sciences, sports technology and high performance sports training for Olympic sports especially focusing on Athletics, Volleyball, Basketball, Football, Handball, Hockey, Wrestling and Boxing; (v) to provide the knowledge of advanced physical education and sports coaching, providing specially designed academic training programmes in various areas of physical education, sports sciences and also advanced technologies of sports training which includes theoretical inputs and practical activity training to generate expertise and strengthening physical education and sports training programme to promote sports performances; (vi) to establish centres and institutions of excellence for imparting state of the an educational training and research in the fields of physical education and sports sciences, sports technology and high performance training for all sports and games including indigenous games and martial arts; (vii) to generate interdisciplinary capabilities and collaborations for the development of knowledge, skills and competencies at various levels in the Held of physical education and sports sciences, sports medicine, biomechanics, sports nutrition, sports technology, sports communication and journalism, disability sports, yoga, exercise and fitness therapy, tourism and adventure sports, water sports, sports management, sports Psychology and high performance training for all sports and games; (viii) to generate capabilities to provide infrastructure of international standard for education, training and research in the areas related to physical education and sports sciences, sports technology, and high performance training for all sports and games; (ix) to prepare highly qualified professionals in sports related specialized fields (counselling, testing data analytics, fitness and wellness, sports injury management, virtual reality/artificial intelligence applications, life-guard management in the Held of physical education and sports sciences, sports technology and high performance training for all sports and games; (x) to serve as a Centre of Excellence for the elite sports persons, coaches and athletes of all sports and games and innovation in physical education and to carry out, endorse and propagate research, testing methodology to develop sports culture in the State; (xi) to (unction as a leading resource centre for knowledge and development in the area of physical education and sports sciences, sports technology, sports event management, sports mass communication and high performance training for all sports and games; (xii) to provide international collaboration in the fields of physical education and sports sciences, sports technology, bio mechanics, nutrition and high performance training for all sports and games; (xiii) to establish close linkage with schools, colleges, Universities, sports and recreation clubs, societies, sports associations boards and international sports federations. Academies and institutes for the purpose of teaching, training and research in physical education and sports sciences, sports technology, sports medicines and high performance training for all sports and games; (xiv) such other objects, not inconsistent with the provisions of this Act which the State Government may, on an application by the University, by notification in the Gazette, specify in this behalf: (xv) to provide vocational guidance and placement services in physical education, sports sciences, sports medicine, sports technology and other related fields. 6. University lobe open to all caste, creed, race or class. - The University shall be open to persons of any sex and of whatever caste, creed, race or religion, class, place of birth, religious belief or profession or political or other opinion in order to entitle him/her to be admitted as a teacher of the University or to hold any other office therein or to be admitted as a student in the University or to graduate there at or to enjoy or exercise any privilege thereof: Provided that nothing in this section shall be deemed to prevent the University from making special provisions for the employment or admission of women, persons with disabilities or of persons belonging to the weaker sections of the society and. in particular, of the Scheduled Castes, the Scheduled Tribes. Other Backward Classes and the other economically and educationally backward classes of citizens. 7. Powers and functions of the University. - Subject to the provisions of this Act the powers and functions of the University shall be ,* (a) Administrative powers and functions:- (i) to administer and manage the University and the associated colleges and to establish such institutes and centre for research, education and instructions as are necessary for the furtherance of the objects of the University: (ii) to hold examinations and confer degrees, diplomas, or grant certificates and other academic distinctions or titles on persons subject to such conditions as the University may determine, and to withdraw or cancel any such degrees, diplomas, certificates or other academic distinctions or titles in the manner as may be prescribed: (iii) to confer honorary degrees or other distinctions in the manner as may be prescribed: (iv) to establish such specialized study centres or other units for research and development as arc, in the opinion of the University, necessary for the furtherance of its objects: (v) to collaborate or associate with any educational institution with like or similar objects for the design and introduction of specialized standalone courses: (vi) to develop and maintain linkages with educational or other institutions in any pan of the world having objects wholly or partially similar to those of the University, through exchange of teachers, students and scholars and generally in such manner as may be conducive to their common objects: (vii) to develop and maintain relationships with teachers, coaches, researchers, experts, sports associations and federations in any part of the world for achieving the objects of the University: (viii) to establish, maintain and manage sports infrastructure, halls and hostels for the residence of students and accommodation for faculties, officers and employees of the University; (ix) to supervise and control the residence and to regulate the discipline among the students of the University and to make arrangement for promoting their health and general welfare and cultural activities; (x) to institute and award fellowships, scholarships, prizes, medals and other awards; (xi) to purchase or to take on lease any land or building or sports complex or sports infrastructure and scientific sports research equipments or indoor stadium on works which may be necessary or convenient for the purpose of the University on such terms and conditions as it may think fit and proper and to construct, alter and maintain any such buildings or works; (xii) to sell, exchange, lease or otherwise dispose of all or any portion of the properties of the University, movable or immovable, on such terms as it may think fit, consistent with the interest, activities and objects of the University, after taking prior permission of the State Government; (xiii) to execute conveyances regarding transfers, mortgages, leases, licenses, agreements and other conveyances in respect of the property, movable or immovable including Government securities belonging to the University or to be acquired for the purpose of the University, after taking prior permission of the State Government: (xiv) to create academic, technical, administrative, ministerial and other posts and to make appointments thereto either on permanent post or on temporary post or on contractual basis ; (xv) to institute professorships, associate professorships, assistant professorships, readerships, lectureships, endowed professorship, honorary professorships, adjunct professorships, emeritus professorships, of different sports and games and any other teaching, academic or research posts for sports sciences and to prescribe qualifications for them; (xvi) to appoint persons as Director, Deans, Professors, Associate Professors, Assistant Professors, Readers, Lecturers, Head Coaches, Coaches, Trainers, Adjunct Professors, or otherwise as teachers and researchers of the University; (xvii) to regulate and enforce discipline among the employees of the University and to provide for such disciplinary measures as may be prescribed: (xviii) to do all such other acts and things as the University may consider necessary, conducive or incidental to the attainment or enlargement of all or any of the objects of the University; (xix) to be admitted as a student of the University or in any affiliated course of the University in any college/institution, a student must have at least won a medal/prize at (he District Level Sports Competition in an Olympic Sports; (xx) to appoint to the post of Vice-Chancellor of the University, a person as per the qualification prescribed under section 12 of this Act; (xxi) to have liaison or membership with various international professional organisations or bodies; (xxii) to co-operate or collaborate or associate with any other University or authority or institution of higher learning, including those located outside the country, in such manner and for such purposes as the University, may determine; (xxiii) to act as a technical advisory body to State Government and State/National Sports Federations on all matters related to sports; (xxiv) to admit to its privileges any College or Institution in or outside India subject to such conditions as may be laid down by the Statutes: (xxv) to recognise persons for imparting instruction in any College or Institution admitted to the privileges of the University; (b) Academic, curriculum and research related powers and functions:- (i) to run a Bachelor of Sports person (three year Degree Course) with specialization in one of the Olympic sports, focusing on Athletics, Volleyball, Basketball, Football, Handball, Hockey, Wrestling and Boxing, where the evaluation of the Bachelor's Degree will be based on participation and winning medals in the National and International Sports Competitions; (ii) to admit sports persons who have proven their sports talent at the district level and ready to join the university and to groom sports persons at an early stage (e.g. age of 12 years onwards) so that they can join the University at a later stage. (iii) to provide for instruction, coaching, training and research in such branches of knowledge or learning pertaining to the physical education, sports sciences, sports technology and high performance training for all sports and games; (iv) to conduct innovative experiments in new methods and technologies in the field of sports sciences, technology and management in order to achieve scientific sports training system for all sports and games and international standards of such physical education, sports training and research in sports sciences; (v) to prescribe courses and curriculum and provide for flexibility in the education system and delivery of methodologies including open, electronic and distance learning; (vi) to provide fore-publishing, printing, reproduction and publication of research and other work and to organise exhibitions, workshops, seminars, symposia, conferences, competitions; (vii) to sponsor and undertake research in ail aspects of physical education and sports sciences, sports technology, allied areas and high performance training for all sports and games: (viii) to admit the students for the courses offered by the University' in the prescribed manner: (ix) to provide vocational guidance and placement services in field of sports and its allied activities; (x) to organise and to undertake extramural studies, training and extension services; (xi) to determine standards of admission to the University, which may include examination, evaluation or any other method of testing. (xii) to provide training, coaching and other backup to high level sports persons for achieving success in different national and international sports competition: (xiii) to provide for the preparation of instructional and training materials, including films, cassettes, tapes, video cassettes and other software; (xiv) to provided for semester system, continuous evaluation and choice-based credit system and to enter into agreement with other Universities and academic institutions for credit transfer and joint degree programmes; (xv) to ensure active participation of students in all academic activities of the University, including evaluation of teachers. (c) Finance related powers and functions: - (i) to regulate the expenditure, manage the finance and to maintain accounts of the University; (ii) to receive grants, subventions, subscriptions, donations and gifts for the purposes of the University and consistent with the objects for which the University is established and to enter into any agreement with the Central Government, the State Government. PSUs, the University Grants Commission or other authorities or bodies tor receiving any grants; (iii) to receive funds from the industries, associations, federations or from any other sources as gifts, donations, benefactions or bequests by transfer of movable and immovable properties for the purposes and objects of the University: (iv) to fix, demand and receive or recover fees and such other charges as may be prescribed; (v) to draw and accept, to make and endorse, to discount and negotiate Government promissory notes and other promissory notes, Acts of exchange, cheques or other negotiable instruments: (vi) to raise and borrow moneys on bonds, mortgages, promissory notes or other obligations or securities founded or based upon all or any of the properties and assets of the University or without any securities and upon such terms and conditions as it may think fit and to pay out of the funds of the University, all expenses incidental to the raising of moneys, to repay money borrowed, after taking prior permission of the State Government: (vii) to invest the funds of the University in accordance with the provisions of the Act; (d) Miscellaneous powers and functions:- (i) to maintain all reports of activities, finances etc. in public domain in a web portal: (ii) to give effect to the procedures and standards provided under the Khelo India Scheme or the National Sports Talent Search and Identification Scheme: (iii) accreditation shall be obtained from the National Assessment and Accreditation Council or any other accrediting agency at the national level; and (iv) e-governance shall be introduced with effective management information. 8. Power of delegation. - Subject to the provisions of this Act and the regulations made thereunder, any officer or authority of the University may, by order, delegate his or its powers (except the power to make regulations) to any other officer or authority under his or its control subject to the condition that the ultimate responsibility for the exercise of the powers so delegated shall continue to rest in the officer or authority delegating them. 9. State Government's power of inspection and inquiry. - (1) The State Government shall have the power to cause an inspection to be made by such person or persons as it may direct of the University, its buildings, sports facilities infrastructure, libraries, laboratories, museum, workshop, and equipments of any college, institution or centre maintained, or affiliated to the University, and also of the teaching, and other works conducted by the University and of the conduct of examination held by the University, and to cause an inquiry to be made in like manner in respect of any matter connected with the administration, academic affairs and finances of the University or Colleges. (2) The State Government shall in every matter referred to in sub-section (1) give notice to the University of its intention to cause an inspection or an inquiry to be made and the University shall be entitled to be represented thereat. (3) The State Government shall communicate to the University its views with reference to results of such inspection or inquiry and advise the University for the action to be taken in the matter. (4) Where the University docs not within the reasonable time, take action to the satisfaction of the State Government, the State Government may issue such directions to the University as it thinks fit and the University shall comply with such directions. Chapter III Officers And Authorities of University [10. The following shall be the officers of the University, namely: - (i) the Chancellor: (ii) the Vice-Chancellor; (iii) the Directors; (iv) the Deans; (v) Head Coaches; (vi) the Registrar, (vii) the Controller of Examinations; (viii) the Librarian; (ix) the Finance Officer; and (x) such other persons as may be declared by regulations, to be the officers of the University.] 11. The Chancellor. - (1) The Governor shall be the Chancellor of the University. He/She shall be the ex-officio head of the University and shall, when present, preside at any convocation of the University. (2) Every proposal for the conferment of any honorary degree shall be subject to the confirmation by the Chancellor. (3) It shall be the duty of the Vice-Chancellor to furnish such information or record relating to the administration of the affairs of the University, as the Chancellor may call for. (4) The Chancellor shall have such other powers as may be conferred on him/her by or under the Statutes. 12. The Vice-Chancellor. - (1) The Vice-Chancellor shall be whole lime salaried officer of the University and shall be appointed by the Chancellor from among the persons whose names arc submitted to him/her by the committee constituted under sub-section(3) in accordance with the provision of sub-section (2). (2) (a) Essential Qualification :- The person appointed to the post of Vice-Chancellor shall be an international level player, must be a graduate and have attained the minimum age of 21 years; (b) Preferential Qualification He/She should have won a medal in the Olympic Games or World Cup/World Championship: or winner of medal in Asian Games or Commonwealth Games in an Olympic sports discipline; or person who is an Arjuna awardee or Khel Ratna awardee or Padmashri awardee in the field of sports or Dhyanchand awardee. (c) If such a person is not available then the Vice-Chancellor shall be a person who has not attained the age of sixty-two years on the date of nomination and who shall:- (i) be an eminent educationist; or (ii) be a renowned physical educationist and sportsperson; or (iii) be a researcher with excellent research work published in reputed National or International periodical journals and holds a Doctorate Degree in the field of physical education . (3) The committee referred to in sub-section (I) shall consist of three members (a) One member shall be a renowned sports personality to be nominated by the Chancellor; (b) One member shall be the Secretary in-charge of the Sports Department of the State; (c) One member (not being a person connected with the University, an institute, a constituent college, an associated or affiliated college or a hall or hostel) to be elected by the Board from Uttar Pradesh Olympic Association: Provided that where the Board fails to elect any person in accordance with clause (c), then the Chancellor shall nominate in addition to person nominated by him/her under clause (a), one person in lieu of the representative of the Board. (4) The Committee so appointed under sub-section (3) shall within such time and in such manner as directed by the State Government. select three persons who possess the qualifications mentioned in sub-section (2) whom it considers fit for being appointed to the post of Vice-Chancellor and shall recommend to the State Government, the names of the persons so selected together with such other particulars as it may deem necessary. (5) The Vice-Chancellor shall hold office for the period of three years and shall be eligible for re-appointment for a further period of three years: Provided that a person shall not hold office of the Vice-Chancellor after he/she attains the age of sixty-five years. (6) The emoluments and other terms and conditions of the service of the Vice-Chancellor shall be such as may be determined by the Slate Government. (7) The Vice-Chancellor may resign from his office by writing under his hand addressed to the Chancellor and such resignation shall take effect from the date of acceptance by the Chancellor. (8) Whenever a temporary vacancy occurs in the office of Vice-Chancellor and it cannot be conveniently and expeditiously filled up in accordance with the provisions of this section, the Chancellor may direct any of the officers of the University to carry on the current duties of the office of the Vice-Chancellor. (9) A person shall be disqualified for being appointed, or for being a Vice-Chancellor- (i) if he/she is a member of the Parliament, or of any State Legislature or of any local authority : or (ii) if he/she is a member of a political party ; or (iii) if he/she is or any time has been adjudged an insolvent or he/she has suspended payment of his debts or has compounded with his creditors ; or (iv) if he/she is of unsound mind or stands so declared by the competent court; or (v) if he/she is or has been convicted of an offence, which in the opinion of the State Government, involves moral turpitude. 13. Power and duties of the Vice-Chancellor. - (1) The Vice-Chancellor shall have, subject to the provisions of this Act. power to cause an inspection or review to be made by such person or persons as he/she may direct, of the University, its buildings, hostels, libraries, sports infrastructure facilities, equipments, systems, processes and of any institution or centre maintained by the University, and also of the examinations, teaching, research and other work conducted or done by the University and to cause an inquiry to be made in like manner in respect of any matter connected with the administration, academic affairs and finances of the University. (2) Without prejudice to the generality of the foregoing provisions, the Vice* Chancellor shall - (i) be the chief executive and academic officer of the University. He/She shall preside over the meetings of the Academic and Activity Council; (ii) ensure implementation of the decisions of the authorities of the University; (iii) be responsible for imparting of instructions and maintenance of discipline in the University; and (iv) exercise such other powers and perform such other duties as may be assigned to him/her by or under this Act or the regulations or as may be delegated to him/her by the Board. (3) Where any matter is of urgent nature requiring immediate action and the same cannot be immediately dealt with by the authority or body of the University empowered under this Act to deal with it, the Vice-Chancellor may take such action as he/she may deem fit and shall forthwith inform the action so taken by him/her to the authority or body of the University who or which, in the ordinary course, would have dealt with the matter: Provided that if such authority or other body is of the opinion that such action ought not to have been taken by the Vice-Chancellor, it may refer the matter to the Board which may cither confirm the action taken by the Vice-Chancellor or annul the same or modify it in such manner as it thinks fit, and thereupon the action shall cease to have effect or as the case may be, shall take effect in such modified form so however that such modification or annulment shall be without prejudice to the validity of anything previously done by on under the order of the Vice-Chancellor. (4) Where the exercise of the powers by the Vice-Chancellor under sub-section (3) involves the appointment of any person, such appointment shall be confirmed by the competent authority empowered to approve such appointment in accordance with the provisions of this Act and the regulations, not later than six months from the date of order of the Vice-Chancellor, otherwise such appointment shall cease to have effect on the expiration of a period of six months from the date of order of the Vice-Chancellor. 14. Director. - (1) The Directors of the University shall be appointed by the Vice-Chancellor with the approval of the Board in such manner and on such terms and conditions as may be prescribed. (2) The Directors shall assist the Vice-Chancellor in managing the academic, physical activities, administrative, financial and other affairs of the University and shall exercise such powers and perform such functions as may be prescribed or entrusted to them by the Vice-Chancellor. (3) The person to be appointed as a Director shall be a trainer/ teacher/Lecturer,Professor of the University or be eligible to teach in any of the affiliated courses of the University' in any college/institution, or a trainer/teacher/Lecturer/Professor who has at least won a medal in National Championship (Senior category)/National Games and preferably played at the National or International Level in an Olympic Sport discipline. 15. Deans. - (1) The Deans shall be appointed by the Vice-Chancellor from amongst the faculties of the University by following the due process of law. (2) The Deans shall assist the Vice-Chancellor and Director of the University in managing the academic and other affairs of the University and shall exercise such powers and perform such functions as may be prescribed or entrusted to them by the Vice- Chancellor and the Director. (3) The person (o be appointed as a Dean shall be a trainer/teacher/ Lecturer/Professor of the University or be eligible to teach in any of the affiliated courses of the University in any college/institution, a trainer/teacher/lecturer/Professor who has at least won a medal in National Championship (Senior category)/National Games and preferably played at the National or International Level in an Olympic Sport discipline. 16. Head Coaches. - (1) The Head Coaches shall be appointed by the Vice-Chancellor from amongst the coaching faculties of the University by following the due process of law. (2) The Head Coaches shall assist the Vice-Chancellor and Director of the University in managing the academic and other training affairs of the University centre for high performance training and shall exercise such powers and perform such functions as may be prescribed by the Statute or entrusted to them by the Vice-Chancellor and the Director. (3) The person to be appointed as a Head Coach shall be a trainer/teacher/ Lecturer/Professor of the University or be eligible to teach in any of the affiliated courses of the University in any college/institution, a trainer/teacher/Lecturer/Professor who has at least won a medal in National Championship (Senior category National Games and preferably played at the National or International Level in an Olympic Sport discipline. 17. Registrar. - (1) The Registrar shall be appointed by the State Government in such manner and on such terms and conditions as may be prescribed. (2) The Registrar shall exercise the following powers and perform the following duties, namely :- (i) he shall be responsible for the custody of records, common seal, the funds of the University and the property of the University; (ii) he shall place before the Board and other authorities of the University, all such information and documents as may be necessary for transaction of its business; (iii) he shall be responsible to the Vice-Chancellor for the proper discharge of his functions; (iv) he/she shall be responsible for the administration of the University and conduct the examinations and make all other arrangements necessary thereof and be responsible for the execution of all processes connected therewith; (v) he shall attest and execute all documents on behalf of the University; (vi) he shall verify and sign the pleadings in all suits and other legal proceedings by or against the University and all processes in such suits and proceedings shall be issued to and served on the Registrar: and (vii) he shall exercise such other powers and perform such other duties as may be assigned to him by or under this Act, the regulations or as may be delegated to him by the Board or the Vice-Chancellor. [17A. finance Officer. - (1) The Finance Officer shall be appointed by the State Government from amongst the officers of Uttar Pradesh Finance Services, and the terms and conditions or services of the Finance Officer shall be governed according to the concerned service rules of the State Government. (2) The Finance Officer shall be subject to disciplinary control of the State Government. However, the Executive Council may report irregularities or recommend action against the Finance Officer to the State Government after making appropriate inquiry. (3) The Finance Officer shall be the ex officio Secretary of the Finance Committee, but shall not be deemed to be a member of such Committee.] 18. Other Officers. - The appointment and powers of other officers of the University shall be such as may be prescribed from time to time. 19. Authorities of the University. - The following shall be the authorities of the University, namely: - (i) the Board of Governors; (ii) the Executive Council; (iii) the Academic and Activity Council; (iv) the Finance Committee: and (v) such other authorities as may be declared by regulations to be the authorities of the University. 20. Board of Governor. - (1) The Board of Governors of the University shall consist of the following members, namely: - (i) the Chancellor, who shall be the Chairman of the Board: (ii) the Vice-Chancellor. (iii) one Director of the University, by rotation, to be nominated by the Vice-Chancellor, (iv) One Head Coach by rotation, to be nominated by the Vice-Chancellor: (v) four persons to be nominated by the State Government. (2) The Registrar shall be the Secretary of the Board. 21. Powers and functions of the Board. - (1) Subject to the provisions of this Act, the Board shall be responsible for the general superintendence, direction and control of the affairs of the University and shall exercise all the powers of the University, and shall have the power to review live acts of the Academic and Activity Council, the Finance Committee and other committees or authorities of the University. (2) Without prejudice to the provisions of sub-section (1), the Board shall have the following powers and functions, namely: - (i) to take decisions on question of policy relating to the administration and working of the University, to review, from time to time, the broad policies and programmes of the University, and to suggest measures for the improvement and development of the University: (ii) to institute courses of study in the University; (iii) to make regulations: (iv) to consider and approve the Annual Report and the annual budget of the University for every financial year and to consider audit report of such account; (v) to invest money and funds of the University and to take decision on the recommendations of the Finance Committee: (vi) to publish or finance the publication of studies, books, periodicals, reports and other literature from time to lime and to sell or arrange for the sale as it may deem fit; (vii) to create or abolish posts of teachers, officers and employees of the University; (viii) to appoint such committees as it considers necessary for the exercise of its powers and performance of its duties under this Act; (ix) to delegate any of its power to the Directors, Deans, Registrar, Head Coaches or any other officer, employee or authority of the University or to a Committee appointed by it; and (x) to exercise such other powers and perform such other functions as may be conferred or imposed upon it by or under this Act or the regulations, and such other powers for achieving the objects of the University. 22. Term of office of members of the Board. - (1) Save as otherwise provided in this section, the term of a member of the Board nominated under clauses (iii), (iv) and (v) of sub- section (I) of section 20 shall be three years from the date of his nomination. (2) A member nominated under clauses (iii), (iv) and (v) of sub-section (1) of section 20 may resign from his office by writing under his hand address to the Chairman and his resignation shall take effect from the date of its acceptance by the Chairman. 23. Executive Council. - (1) The Executive Council shall be the principal executive body of the University. (2) The constitution of the Executive Council, the term of office of its members and its powers and functions shall be such as may be prescribed in the Statutes. 24. Academic and Activity Council. - (1) The Academic and Activity Council of the University shall consist of the following members, namely:- (i) the Vice-Chancellor, who shall be the Chairman of the Academic and Activity Council: (ii) two academicians or professionals, to be nominated by the Board; (iii) two academicians or professionals in the field of physical education and sports sciences, who have achieved distinction in Olympics or World championship, to be nominated by the Board; (iv) the Director of the University; (v) one Dean of the University, by rotation, to be nominated by the Vice-Chancellor; (vi) one Head Coach, by rotation, to be nominated by the Vice-Chancellor: and (vii) one professor front each faculty of University department, by rotation, to be nominated by the Vice Chancellor. (2) The Registrar shall be the Secretary of the Academic and Activity Council. (3) The term of office of the members nominated under clauses (ii), (iii), (v). (vi) and (vii) of sub-section (1) shall be three years. 25. Powers and functions of the Academic and Activity Council. - Subject to the provisions of this Act and the regulations made thereunder the Academic and Activity Council shall exercise the following powers and perform the following functions, namely: - (i) exercise control over the academic policies of the University and be responsible for the maintenance and improvement of standards of instruction, education and evaluation in the University: (ii) consider matters of general academic interest either on its own initiative or on a reference from the faculty of the University or the Board and to take appropriate action thereon; (iii) recommend to the board each regulations as are consistent with this Act regarding the academic functioning of the University including discipline among students; and (iv) exercise such other powers and perform such other functions as may be conferred or imposed upon it by the regulations. 26. Finance Committee. - (1) The Finance Committee shall consist of the following members, namely: - (i) the Vice-Chancellor, who shall be the chairperson thereof; (ii) two members of the Board (one of them shall be a Government nominee of the Board), to be nominated by the Board: (iii) the Director (Finance); (iv) one expert in the field of finance, to be nominated by the Board; (v) one professor, by rotation, to be nominated by the Board: (vi) one Head Coach, by rotation to be nominated by the Board. (2) The Registrar shall be the Secretary of the Committee. (3) The term of office of the members nominated under clauses (ii), (iv), (v) and (vi) shall be three years. 27. Powers and function of Finance Committee. - Subject to the other provisions of this Act, the Finance Committee shall exercise the following powers and perform the following functions, namely: (i) examine the annual accounts and annual budget estimates of the University and to advise the Board thereon: (ii) review from time to time the financial position of the University: (iii) make recommendations to the Board on all financial policy matters of the University: (iv) make recommendations to the Board on all proposals involving raising of funds, receipts and expenditure: (v) provide guidelines for investment of surplus funds: (vi) make recommendations to the Board on all proposals involving expenditure for which no provision has been made in the budget or which involves expenditure in excess of the amount provided in the budget needs to be incurred: (vii) examine all proposals relating to the revision of pay scales, up gradation of the scales and those items which are not included in the budget prior to placing before the Board: and (viii) exercise such other powers and perform such other functions as may be conferred or imposed upon it by the regulations. Chapter-IV Affiliation 28. Affiliation. - (1) The Board may with the previous sanction of the State Government admit any college which fulfils such conditions of affiliation, as may be prescribed : Provided that unless all the prescribed conditions of affiliation arc fulfilled by a college, it shall not admit any student in the first year of the course of study for which affiliation is granted under the foregoing proviso after one year from the date of commencement of such affiliation. (2) A college or institution applying for affiliation to the University shall submit an online application with e-Sign in the prescribed format to the Registrar, six months prior to the proposed date of starting the college. (3) Any college or institution applying for affiliation shall apply online in such form along with such fees and security in such manner and shall fulfil such norms and criteria as may by prescribed. (4) The College/Institution should have teaching faculty as per guidelines issued by respective regulatory bodies concerned with the discipline. (5) In addition the College/Institution should have a formal agreement for the entire duration of the courses with the Associated Activities School/Colleges as defined in clause (c) of section 2 of this Act. (6) On receipt of the application made under sub-section (2), the Board shall, in consultation with the Academic Council and after giving to the college or the institution an opportunity of stating its case, determine whether the college will meet a need in the locality, having regard to the type of education intended to be provided by the college, the existing provision for the same type of education made by other colleges in the neighbourhood and the suitability of the locality where the college is to be established and comply with the provisions of the Act and the regulations, record its opinion as to whether the affiliation should be granted or refused either in whole or in pan and communicate the decision online to the college or institution. In case of minor deficiencies a time duration for compliance before the start of the course can be stipulated. No course shall commence unless all the conditions arc fulfilled. (7) Where an application for affiliation or any part thereof is granted, the order of the Board shall specify the courses of the instruction in respect of which the college is affiliated and where the application or any part thereof is refused, the grounds of such refusal shall be recorded and shall be communicated online to the college or institution within 30 days. (8) Any college or institution not satisfied with the decision of the Board under sub-section (6). may prefer an appeal to the State Government within sixty days from the date of communication of such decision or order and the decision of the State Government on such appeal shall be final. (9) It shall be lawful for an affiliated college to make arrangement with any other affiliated or associated college situated in the same local area, or with the University, for cooperation in the work of leaching or research. (10) Except as provided by this Act, the management of an affiliated college shall be free to manage and control the affairs of the college and be responsible for its maintenance and upkeep, and its Principal shall be responsible for the discipline of its students and for the superintendence and control over its staff. (11) Every affiliated college shall furnish self certified reports, returns, on prescribed performs and other particulars online which may be inspected and verified on randomized basis by officers authorized by the Vice-Chancellor. (12) The Executive Council shall cause every affiliated college to be inspected from lime to time at intervals not exceeding two years by one or more persons authorised by it in that behalf, and a report of the inspection shall be made to the Executive Council. (13) The Executive Council may direct an affiliated college so inspected to take such action as may appear to it to be necessary within fifteen days. (14) The Privileges of affiliation of a college which fails to comply with any direction of the Executive Council under sub-section (11) or to fulfill the conditions of affiliation may, after obtaining a report from the Management of the college and with the previous sanction of the State Government, be withdrawn or curtailed by the Executive Council in accordance with the provision of the Statutes. (15) Notwithstanding anything contained in sub-section (1) and (12), if the Management of an affiliated college has failed to fulfil the conditions of affiliation, the State Government may, after obtaining a report from the Management and the Vice-Chancellor, withdraw or curtail the privileges of affiliation. (16) Notwithstanding anything to the contrary contained in any other provisions of this Act, a college, which has already been given affiliation to a University before the commencement of this Act in specific subject for a specified period shall be entitled to continue the course of study for which admissions have already taken place but it shall not admit any student in the first year of such course of study without obtaining affiliation under sub-section (1). 29. Extension of affiliation. - Where an affiliated college desires to add the courses of instruction in respect of which it is affiliated, the procedure prescribed under section 28 shall be followed. 30. inspection of affiliated colleges and report. - (1) Every affiliated college shall furnish such reports, returns and other information as the Board, after consulting the Academic and Activity Council, may require in order to judge the efficiency of such college. (2) College shall do annual self certification and upload on as per a standard proforma format and upload it on the designated portal. (3) The Board shall cause every such college (to be inspected from time to time by the inspection committee consisting of the Vice-Chancellor who shall be the Chairman and such other members, as may be appointed by the Board in accordance with the Statutes. (4) It shall be the duty of the inspection committee on the directions of the Board in this behalf, to inspect an affiliated college, and make a report to the Board. (5) The Board may call upon the college so inspected to take, within a specified period, such actions as may appear to it to be necessary. 31. Withdrawal of affiliation. - (1) The privilege of affiliation granted under section 28, may be withdrawn or modified if the College fails to carry out any of the provisions of this Act or the Statutes made thereunder or fails to observe any of the conditions of its affiliation or the college is conducted in a manner which is prejudicial to the interests of education. (2) A motion for the withdrawal or the modification of such rights shall be initiated only by the Board. The member of the Board who intends to move such a motion shall give a notice of it and shall state in writing the grounds on which it is made. (3) Before taking such a motion into consideration, the Board shall send a copy of the notice to the Principal of the College concerned, together with intimation that any representation in writing submitted within a period specified in such intimation on behalf of the college will be considered by the Board: Provided that the period so specified may, if necessary, be extended by the Board. (4) On receipt of the representation or on the expiry of the period referred to in sub-section (3), the Board after considering the notice of motion, statement and the representation, and after such inspection by any competent person or persons authorised by the Board in this behalf, and such further inquiry as may appear to it to be necessary and after consulting the Academic and Activity Council, shall by a resolution on the grounds stated therein, withdraw in whole or in part, or modify, the rights conferred by the affiliation and shall communicate the same to the concerned college: Provided that where the views of the Academic and Activity Council with regard to the withdrawal or modification of the rights conferred by affiliation arc not acceptable to the Board, it shall, before passing such resolution, refer the matter again to the Academic and Activity Council, with or without its comments and the Academic and Activity Council shall communicate again its views in the matter to the Board. 32. Appeal against withdrawal of affiliation. - Any college aggrieved by the resolution withdrawing wholly or partly or modifying the rights conferred by affiliation passed under section 31. may make an appeal to the State Government within sixty days from the date of communication of the resolution and the decision of the State Government on such appeal shall be final. 33. Withholding or reduction of grant to an affiliated college. - The Board may. on the recommendation of the Academic and Activity Council, recommend the State Government to withhold or reduce the grant to an affiliated college which, on a report by inspection committee or otherwise, is found to be making persistent default in carrying out the conditions of affiliation. 34. Post-graduate teaching. - All the post-graduate instructions, teaching and training shall be conducted by the University or by the affiliated college in such subjects as may be recognised by the University. Chapter-V Finance 35. Permanent Endowment Fund of the University. - There shall be a "Permanent Endowment Fund" to which the State Government shall make an initial contribution of rupees ten crore. The method of raising Endowment Fund and the investment of the surplus shall be such as may be prescribed. 36. Payment by State government to the University. - The State Government shall pay to the University from time to time such sum of money and in such manner as may be considered necessary for the exercise of powers and discharge of its functions by the University under this Act. 37. Fund of the University. - (1) The University shall establish a fund to be called the 'University Fund' consisting of - (i) any contribution or grants or loans by the State Government and Central Government; (ii) the income of the University from all sources including income from affiliation fees and charges; (iii) the moneys received by the University by way of grants, loans, gifts, donations, benefactions, bequests or endowments and other grants, if any; (iv) the moneys received by the University from the collaborating industries in terms of the provisions of the Memorandum of Understanding entered between the University and the industry, for establishment of sponsored chairs, fellowships or infrastructure facilities of the University; and (v) the moneys received by the University in any other manner or from any other sources. (2) The surplus fund of the University shall be deposited in Nationalised Banks or invested in such manner by the Beard on the recommendation of the Finance Committee-or as per instructions of the Suite Government from time to time in that behalf. (3) The funds of the University shall be applied towards the expenses of the University including expenses incurred in the exercise of its powers and discharge of its functions by or under this Act. 38. Accounts, audit and annual report. - (1) The University shall maintain proper accounts and other relevant records and prepare an annual statement of accounts, including the income and expenditure accounts and the balance sheet, in such form and in such manner as may be prescribed. (2) The University shall adopt a proper system of internal checks and balances and control in the discharge of its financial, accounting and auditing functions as may be prescribed. (3) The audit of the accounts of the University shall be carried out by the Examiner. Local Fund Audit under the provisions of the Uttar Pradesh Local Fund Audit Act, 1984. (4) Special audit shall be carried out by the Comptroller and Auditor General of India or by such persons as he may authorise in this behalf. (5) The audit report of accounts referred under sub-section (3) shall be placed before the Board and the Board may issue such instructions to the University in respect thereof as it deems fit and the University shall comply with such instructions. (6) The University shall prepare for each year an annual report of its activities of the previous year containing such particulars as the Board may specify and submit the same in the form of annual report to the Board on or before such date as may be prescribed, for review and approval. (7) The copy of the annual report and annual audit report along with the resolution of the Board thereon shall be submitted to the State Government. 39. Pension. - All officers, teachers and other employees who are in the nature of permanent employment of the University shall be members of the New Pension Scheme of the State Government. Chapter-VI Supplementary Provisions 40. Acts and proceedings not to be invalid by vacancies. - No act or proceedings of the Board or any authority of the University or any committee constituted under this Act or by regulations shall be invalid merely on the ground of the existence of any vacancy in or defect of. in the constitution of such Board, authority or committee of the University. 41. Conferment of Degrees Diplomas and grant of certificates by University. - Notwithstanding anything contained in any oilier State law for the time being in force, the University shall have powers to confer degrees, diplomas and grant certificates and confer honorary degrees and other academic distinctions and titles as approved by the Board. 42. Returns and information. - The University shall furnish to the State Government, University Grants Commission and other statutory authorities, such reports, returns, statements and other information with respect to its properties or activities, within such period as may be required by them from time to time and upload the same on its website and designated portal. 43. Officers and employees to be public servant. - Every officer, teacher and employee of the University shall be deemed to be a public servant within the meaning of section 21 of the Indian Penal Code, 1860 (Act no. 45 of 1860). Explanation. - for the purpose of this section, any person, who is appointed by the University for a specified period or a specified work of the University or who receives any remuneration by way of allowances or fees for any work done from the University Fund, shall be deemed to be an officer or employee of the University while he/she is performing die duties .aid functions connected with such appointment or work. 44. Dismissal renewal reduction or termination of service of state of University. - (1) Every employee of the University shall be appointed under a written contract, which shall be lodged with the University and a copy of which shall be furnished to the employer concerned. (2) Any dispute consing out of the contract between the University and any employee shall, at the request of the employee, be referred to a tribunal of Arbitration consisting of one member appointed by the Executive Council, one member nominated by the employee concerned and one arbitrator appointed by the State Government. (3) The decision of the Tribunal shall be final and no suit shall be in any civil court in respect of the matters decision decided by the Tribunal: Provided that nothing in this sub-section shall preclude the employee from availing of judicial remedies available under Articles 32 and 226 of the Constitution. (4) Every request made by the employee under sub-section (2) shall be deemed to be a submission to arbitration upon the terms of this section within the meaning of the Arbitration and Conciliation Act, 1996 (Act no. 26 of 1996). (5) No officers or employee or member of the teaching, non-teaching and other academic staff of the University shall be dismissed or removed or reduced in rank except after an inquiry in which he/she has been informed of the charges against him/her and after giving a reasonable opportunity of being heard in respect of those charges. (6) An appeal against an order of dismissal, removal or reduction in rank under sub-section (1) or of termination of service shall be made to the Vice-Chancellor within ninety days from the date of communication of such order and the decision of the Vice-Chancellor in such appeal shall be final. 45. Power of State Government to give directions. - The Slate Government shall have powers to issue directions from time to time as may be required for compliance of the provisions of this Act and the regulations made thereunder and any other law for the time being in force and the University shall be bound to comply with such directions. 46. Statute how to be made. - (1) The first Statutes of the Universities established or incorporated under this Act shall be made by the Executive Council and shall be submitted to the State Government for its approval. (2) The Executive Council may from time to time, make new or additional Statutes or may amend or repeal any Statutes referred to in sub-section (1): Provided that the Executive Council shall not make, amend or repeal any Statutes affecting the status, powers or constitution of any authority of the University until such authority has been given an opportunity of expressing an opinion in writing on proposed changes, and any opinion so expressed shall be considered by the Executive Council. (3) Every new Statutes or Statutes amending or repealing existing Statutes shall require the approval of the State Government and unless so approved, the shall be invalid. (4) Notwithstanding anything contained in the foregoing sub-section, the State Government may make new or additional Statutes or amend or repeal the Statutes referred to in sub-section (1), during the period of three years immediately after the commencement or this Act; Provided that the State Government may, on the expiry of the said period of three years, make, within one year from the date or such expiry, such detailed Statutes as it may consider necessary. Any such detailed Statutes shall be laid before both Houses of Legislature. (5) Notwithstanding anything contained in this section, the State Government may direct the University to make provisions in the Statutes in respect of any matter specified by it and if the Executive Council is unable to implement such direction within sixty days of its receipt, the State Government for its inability to comply with such direction, may make or amend the Statutes suitably. 47. Power to make Ordinances. - (1) Subject to the provisions of this Ac1, the Board shall have in addition to all other powers vested in it, the power to make Ordinances to provide for the administration and management of the affairs of the University. (2) In particular and without prejudice to the generality* of the Tore going powers, such Ordinances may provide for all or any of the following matters, namely:- (i) the summoning and holding of meetings of the authorities of the University, other than the first meeting of the Board and the quorum and conduct of business at such meetings; (ii) such other powers and functions of the Vice-Chancellor; (iii) the constitution, powers and duties of the authorities, bodies and other committees of the University, the qualifications and disqualifications for membership of such authorities, term of office of the membership, appointment and removal of member thereof and other matters connected therewith; (iv) the procedure to be followed by the Board and any committee or other body constituted by or under this Act or by the regulations in the conduct of the business, exercise of the powers and discharge of the functions; (v) the procedure and criteria to be followed in establishing courses of study and curriculum, and admission of students; (vi) the procedure to fee followed for enforcing discipline in the University ; (vii) the management of the properties of the University; (viii) the degrees, diplomas, certificates, and other academic distinctions and titles which may be conferred or granted by the University and withdrawal or cancellation of any such degrees, diplomas, certificates and other academic distinctions and titles and the requirement thereof; (ix) the conduct of examinations including the term of office and appointment of examiners: (x) the creation of posts of Director, Professors, Associate Professors. Assistant Professors, Readers, Lecturers. Head Coaches, Coaches, trainers or equivalent academic designations or posts, officers and employees of the University, and the appointment of persons to such posts including requisite qualifications thereof; (xi) the fees and other charges to be paid to the University for the courses, training, facilities and services provided by it; (xii) the terms and conditions for association of the University with other institutions; (xiii) the preparation of budget estimates and maintenance of accounts: (xiv) the mode of execution of contract or agreements by or on behalf of the University; (xv) the classification and procedure for appointment of officers, employees and other staff of the University; (xvi) the terms and conditions and the tenure of appointment, salaries and allowances, contractual services, rule of discipline and other conditions of service of the Director, Head Coaches, other officers, teachers and employees of the University; (xvii) the terms and conditions governing deputation of teachers, officers and employees of the University; (xviii) the powers and duties of the Director, Head Coaches, other officers, teachers and employees of the University; (xix) the terms and conditions governing fellowships, scholarships, stipends, medals and prizes; (xx) the authentication of the orders and the decisions of the Board; (xxi) the matters relating to hostel for students and halls of residence and housing for faculties, officers and employees and guest house including disciplinary control therein; and (xxii) all matters which by this Act are to be or may be prescribed by the Ordinances. 48. Regulations. - The authorities of the University may make Regulations consistent with this Act, the Statutes and the Ordinances, for the conduct of their own business and that of the Committees, if any, appointed by them and not provided for by this Act, the Statutes or the Ordinances, in the manner prescribed by the Statutes. Chapter-VII Transitory Provisions 49. Appointment of First Vice-Chancellor. - Notwithstanding anything contained in section 12, the first Vice-Chancellor shall be appointed by the Slate Government as soon as practicable after coming into force of this Act for a period not exceeding one year on such terms and conditions as it may think fit. 50. Appointment of First Registrar. - Notwithstanding anything contained in section 17, the first Registrar shall be appointed by the State Government as soon as practicable after the commencement of the Act, for a period not exceeding three years and on such conditions as the State Government thinks fit. 51. Transitory power of Vice-Chancellor. - Notwithstanding anything contained in this Act, the Vice Chancellor may, with the prior approval of the Board and subject to availability of the funds, discharge all or any of the functions of the University for the purposes of carrying out the provisions of this Act and the regulations and for the purpose, may exercise any power or perform any duty which by or under this Act and regulations is to be exercised or performed by any authority of the University until such authority comes into existence in accordance with the provisions of this Act and the regulations. 52. Indemnity. - No suit, prosecution or other legal proceedings shall lie against and no damages shall be claimed from the University, the Vice-Chancellor, the Chairman, the Director, the authorities or officers or employees of the University or any other person in respect of anything which is done or purporting to be done in good faith in pursuance of the provisions of this Act or any regulations made thereunder. 53. Power of the State government to remove difficulties. - (1) If any difficulty arises in giving effect to the provisions of this Act, the State Government may by order whether by way of modification, addition or omission, as it may deem necessary or expedient published in the Gazette, make such provisions not inconsistent with the provisions of this Act as may appear to be necessary for removing difficulties: Provided that no such order shall be made under this section after the expiry of two years from the date of commencement of this Act. (2) Every order made under this section shall be laid, as soon as may be after it is made, before the State legislature. |
