THE U.P. CONTROL OF SUPPLIES (TEMPORARY POWERS) ACT, 1953 (U.P. Act No. 17 of 1953) An Act to re-enact the provisions of the U.P. Control of Supplies (Temporary Powers) Act, 1947 Whereas it is necessary to re-enact the provisions of the UP. Control of Supplies Temporary Powers) Act, 1947. It is hereby enacted as follows:– 1. Short title, extent and commencement. - (1) This Act may be called the U.P. Control of Supplies (Temporary Powers) Act, 1953. (2) It extends to the whole of Uttar Pradesh. (3) It shall come into force at once. Object & Reasons Statement of Objects and Reasons. - The U P. Control of Supplies (Temporary Powers) Act, 1947, which was continued by the U P. Control of Supplies (Continuance of Powers) Amendments Act, 1952, expires on September 30, 1953. The supply position and prices of some of the commodities regulated under the Act necessitate the retention of controls, and make it expedient that the Act, provisions of the Act should remain in force for a further period tall January 25, 1956, the time upto which the life of Government of India Essential Supplies Act, 1946, has also been extended. This Ball is, therefore, being introduced to re-enact the provisions of the said Act upto the said date. Object and Reasons published in U.P. Gazette Extraordinary, dated July 21, 1953. Received the Assent of President on September 29, 1953. 2. Re-enactment of U.P. Control of Supplies (Temporary Powers) Act, 1947. - The provisions of the UP Control of Supplies (Temporary Powers) Act, 1947 (hereinafter called the Principal Act) set out in the Schedule hereto are hereby re-enacted and shall remain in force until the twenty-fifth day of January, [1967] and the provision of Section 6 of the U P. General Clauses Act, 1904 shall apply on the expiry of the said Act as if it had then been repealed by an U P. Act. 3. In the continuation of orders, etc. - (1) Any order made or deemed to be made under the purported exercise of any power under the principal Act and in force immediately before the commencement of the this Act, all appointment made, licenses or permits granted and directions issued under any such order and in force immediately before such commencement shall likewise continue in force and be deemed or be made, granted or issued in pursuance of this Act. (2) For the settlement of doubts it is hereby declared that for purposes of sub-section (1) every order or appointment made, license or permit granted and not expired before the said commencement shall be deemed to be, and always to have been an order or appointment, licence, permit, direction in force immediately before such commencement. |
