THE MAHARASHTRA PUBLIC AUTHORITIES SEALS ACT, 1883

(This Act received the assent of the Governor of Bombay in Council on 25th August, 1883 and the assent of the Viceroy and Governor General on 15th October, 1883; assent was first published in the Bombay Government Gazette, Part IV, on 5th November 1883).
An Act to enable Government to prescribe the Official Seals of Sessions Judges, Magistrates [, members of the State Legislature] and other public authorities.
Whereas it is expedient [* * *] to enable the Government to prescribe what official seals [*] public authorities [* *] shall have and use; It is enacted as follows:-
1. Short title. - This Act may be called [the Maharashtra Public Authorities Seals Act].
[1A. Extent. - This Act extends to the whole of State of Maharashtra.]
2. Repeal of Bombay Act II of 1870. - Bombay Act II of 1870 is hereby repealed. Every notification issued under the said Act and now in force shall be deemed to have been issued under this Act.
3. [State] Government empowered to prescribe the seals of certain public authorities. - The [ [State] Government], may, from time to time, by notification in the [Official Gazette], direct what official seals [each] of the following [* * * *] public authorities shall have and use (namely):-
(1) Sessions Judges, Additional and Joint Sessions Judges and Assistant Sessions Judges;
(2) Presidency Magistrates;
(3) any other Magistrates;
(4) any other judicial officer or public authority, whose official seal is not prescribed by law and no other authority is legally competent to prescribe.
Every such notification may from to time be [modified] or rescinded by the [ [State] Government] by a like notification.
4. Date on which notifications under last section shall take effect. - Every notification made under the last preceding section shall come into force on such date as the [ [State] Government] shall therein fix in this behalf.
[5. Provision for seal for members of State Legislature. - (1) The State Government may, after consultation with the Speaker of the Maharashtra Legislative Assembly and the Chairman of the Maharashtra Legislative Council, by notification in the Official Gazette, direct what official seal the members of the Maharashtra State Legislature shall have and use, as occasion may arise, subject to the provisions of sub-sections (2) and (3).
(2) The official seal may be used by a member of the State Legislature for attesting or authenticating the execution of, or signature on, any deed, instrument or other document, or certifying true copies of any such document, when it is presented to him for such purpose, or for granting any recommendation or certificate, in all cases where the member of the State Legislature is authorised or recognised to do such thing under any law for the time being in force or under any executive orders issued by any Government Department or by any statutory corporate body and for such other purposes as the State Government may, from time to time, by notification in the Official Gazette, specify in this behalf.
(3) Every member of the State Legislature shall be furnished with an official seal by the State Government, which may be used by such member for the purposes referred to in sub-section (2) during the period he continues to be such member and it shall be returned or cause to be returned to the State Government as soon as he ceases to be such member.]
Notifications
G. N., L. A.D., No MIS. 1081/(54)/III, dated 7th July, 1981 (M.G., Part IV-B, page 1557) - In exercise of the powers conferred by sub-section 1 of the Bombay Public Authorities Seals (Amendment) Act, 1981 (Maharashtra XXIV of 1981), the Government of Maharashtra hereby appoints the 15th day of July 1981, to be the date on which the said Act shall come into force.
G. N., J. D., No. 2270, dated 8th April, 1886 (B.G., Part I) - In exercise of the powers conferred by section 3 of the Bombay Public Authorities Seals Act, 1883, the Governor in Council is pleased to direct that Benches of Magistrates constituted under section 15 of the Code of Criminal Procedure, 1882, shall respectively, have and use the same seals which are prescribed for Magistrates of the Classes to which such Benches are under the provisions of the said section of the said code to be deemed to belong.
G. N., H. D. (Poll.), No. S. D. II/HMM-5355, dated 24th November, 1955 (B.G., Part I, page 5721) - In exercise of the powers conferred by section 3 of the Bombay Public Authorities Seals Act, 1883 (Bombay V of 1883), and in rescission of Government Notification in the Home Department (Political), No. S. D. II/HMM. 5355, dated the 5th September, 1955, the Government of Bombay hereby directs that, with effect from the 2nd day of January 1956, the following Honorary Magistrates, while attesting, verifying or authenticating any document, whether executed before them or not, shall have and use seals of the description given below :-
I. Presidency Magistrates, Greater Bombay
Two inches in diameter - Device: "Asoka Capital Motif" - English inscription: "Presidency Magistrate, Greater Bombay".
II. Magistrates of the Second Class
One and three-quarter inches in diameter - Device: "Asoka Capital Motif"- English inscription: "Magistrate of the Second Class, * District" - Inscription in regional language: "Second Class Magistrate, District * " * Note. - here enter the Name of the District.

G., Part IV-B, page 2810) - In exercise of the powers conferred by section 3 of Bombay Public Authorities Seals Act, 1883 (Bombay V of 1883) and in supersession of Government Notification in the Home Department, No. 8081/5, dated the 19th January 1950, the Government of Maharashtra hereby directs that each of the public authorities specified in column 1 of the schedule appended hereto shall have and use the official seals respectively described against it in column 2 of the said schedule:-

7. Magistrates of the First Class A Circular seal two inches in diameter bearing thereon the Asoka Capital Motif with the words "Satyameve Jayate" in Devnagari Script inscribed below it, and the words "Magistrate of the First Class" in English and the words "Pratham-Varg Dandadhikari" in Marathi.

G.N., H.D., No. SB. VI/EXM.-0174-B, dated 1st April, 1974 (M. G., Part I, C. S., page 278) - In exercise of the powers conferred by section 3 of the Bombay Public Authorities Seals Act, 1883 (Bombay V of 1883) and in supersession of Government Notification in the Law and Judiciary Department, No. SRO1057(f)-J, dated the 12th September, 1962, so far as it relates to prescribing the seals which the Taluka Magistrates and the Special Executive Magistrates should have and use, the Government of Maharashtra hereby directs that the Executive Magistrates appointed under section 20 of the Code of Criminal Procedure, 1973 (II of 1974) and the Special Executive Magistrates appointed under section 21 of the said Code, shall have and use the official seals respectively described against them in the schedule appended hereto.

Special Executive Magistrates A Circular Seal 3.81 centimetres (one and half inches) in diameter bearing thereon the Asoka Capital Motif with the words "Satyameva Jayate" in Devnagari script inscribed below it, and the words "Special Executive Magistrate" in English and the words "Vishesh Karyakari Dandadhikari" in Marathi.

G.N., P.W. & H.D., No. BRB-1571/24431(l)/D-36, dated 6th September, 1975 (M. G., Part IV-B, page 843) - In exercise of the powers conferred by section 3 of the Bombay Public Authorities Seals Act, 1883 (Bombay V of 1883), the Government of Maharashtra hereby directs that each of the competent authorities appointed by the State Government under section 41 of the Bombay Building Repairs and Reconstruction Board Act, 1969 (Maharashtra XLVII of 1969), shall have and use the official seal as prescribed below:-
A Circular Seal 3.18 centimetres in. diameter, bearing thereon the Asoka Capital Motif, and the words "Competent Authority, Bombay Building Repairs and Reconstruction Board".
2. This notification shall come into force on the 6th day of September 1975.

G., Part IV-B, page 1557) - In exercise of the powers conferred by sub-section (1) of section 5 of the Bombay Public Authorities Seals Act, 1883 (Bombay V of 1883), the Government of Maharashtra, after consultation with the Speaker of the Maharashtra Legislative Assembly and the Chairman of the Maharashtra Legislative Council hereby directs that subject to the provisions of sub-sections (2) and (3) of the said section 5, the Members of the Maharashtra State Legislature shall have and use the official seal as prescribed below:-
"A Circular Seal 3.81 centimetres (one and half inches) in diameter bearing thereon the pictorial representation of the New Council Hall and the word "Seal" and the words "Member of the Maharashtra State Legislature."
