THE GANDHI NATIONAL MEMORIAL FUND (LOCAL AUTHORITIES' DONATIONS) ACT, 1953

An Act to authorise the use of contributions or donations made by local authorities to the Gandhi Memorial Fund outside the limits of such local authorities.
Whereas it is expedient to make provision for authorising the use of the contributions or donations made by local authorities in the State of Bombay to the fund known as the Gandhi National Memorial Fund, outside the limits of such local authorities; It is hereby enacted as follows :-
1. Short title. - This Act may be called the Gandhi National Memorial Fund (Local Authorities' Donations) Act, 1953.
2. Definitions. - In this Act unless there is anything repugnant to the subject or context,-
(1) "the Gandhi National Memorial Fund" means the fund known as the Gandhi National Memorial Fund started under the auspices of the President of the Indian National Congress;
(2) "local authority" means a municipal corporation constituted under the Bombay Municipal Corporation Act (Bombay Ill of 1888), or the Bombay Provincial Municipal Corporations Act, 1949 (Bombay LIX of 1949), or a municipality constituted under the Bombay District Municipal Act, 1901 (Bombay Ill of 1901), or the Bombay Municipal Boroughs Act, 1925 (Bombay XVIII of 1925), or a district local board constituted under the Bombay Local Boards Act, 1923 (Bombay VI of 1923), or a village panchayat constituted under the Bombay Village Panchayats Act, 1933 (Bombay VI of 1933).
3. Use of contribution or donations for purposes of outside the limits of local authority. - Notwithstanding anything contained in any enactment in regard to any Municipal Fund or Local Fund, contributions or donations made before or after the commencement of this Act to the Gandhi National Memorial Fund by a local authority and used or to be used for a purpose, object or cause outside the local limits of such local authority shall be deemed to have been validly used and may be used for the said purpose, object or cause :
Provided that nothing in this section shall authorise or shall be deemed to have authorised the trustees of the Gandhi National Memorial Fund to use the amount of such contribution or donation for a purpose, object or cause other than that specified by such local authority.
