Received the assent of the Governor on the 5th August 2004 and published in Part IV-Section 2 of the Tamil Nadu Government Gazette Extraordinary, dated the 5th August 2004.



An Act to repeal the Tamil Nadu Animals and Birds Sacrifices Prohibition Act, 1950.



Be it enacted by the Legislative Assembly of the State of Tamil Nadu in the Fifty-fifth year of the Republic of India as follows:-



1. Short title and commencement. - (1) This Act may be called the Tamil Nadu Animals and Birds Sacrifices Prohibition (Repeal) Act, 2004.



(2) It shall be deemed to have come into force on the 20th day of February 2004.



 










Object & Reasons




 










Statement of Objects and Reasons. - Recently, instructions have been issued for enforcing the provisions of the Tamil Nadu Animals and Birds Sacrifices Prohibition Act, 1950 (Tamil Nadu Act XXXII of 1950). Representations have, however, been received from the general public for permitting them to continue the practice of sacrificing animals and birds in the temples and its precincts as a part of their offerings. After considering the representations received from the general public, the Government have decided to repeal the said Tamil Nadu Act XXXII of 1950. Accordingly, the Tamil Nadu Animals and Birds Sacrifices Prohibition (Repeal) Ordinance, 2004 (Tamil Nadu Ordinance 2 of 2004) was promulgated by the Governor on the 20th February 2004 and the same was published in the Tamil Nadu Government Gazette Extraordinary, dated the 20th February 2004.



2. This Bill seeks to replace the said Ordinance.




2. Repeal. - The Tamil Nadu Animals and Birds Sacrifices Prohibition Act, 1950 (Tamil Nadu Act XXXII of 1950) (hereinafter referred to as the principal Act), is hereby repealed.



3. Abatement of action taken and of legal proceedings. - All actions taken under the principal Act and all proceedings thereunder pending immediately before the 20th day of February 2004, before any Court or authority shall abate.



4. Repeal and saving. - (1) The Tamil Nadu Animals and Birds Sacrifices Prohibition (Repeal) Ordinance, 2004 (Tamil Nadu Ordinance 2 of 2004) is hereby repealed.



(2) Notwithstanding such repeal, anything done or any action taken under the said Ordinance shall be deemed to have been done or taken under this Act.
