THE KARNATAKA STATE CIVIL SERVICES (AMENDMENT) ACT, 2009

An Act further to amend the Karnataka State Civil Services Act, 1978.
Whereas, it is expedient further to amend the Karnataka State Civil Services Act, 1978 (Karnataka Act 14 of 1990) for the purposes hereinafter appearing;
Be it enacted by the Karnataka State Legislature in the fifty-ninth year of the Republic of India as follows:-
1. Short title and commencement.- (1) This Act may be called the Karnataka State Civil Services (Amendment) Act, 2009.
(2) It shall come into force at once.
2. Amendment of section 3.- In section 3 of the Karnataka State Civil Services Act, 1978 (Karnataka Act 14 of 1990), (hereinafter referred to as the principal Act), in sub-section (2), after the proviso, the following shall be inserted, namely:-
“Provided further that nothing in clause (a) shall apply to rules specifying the number and nature of the posts.”
3. Amendment of section 5.- In section 5 of the principal Act, in sub-section (3), in the Explanation, for the words, figures and brackets “in sub-section (1) of section 5 of the Prevention of Corruption Act, 1947 (Central Act 2 of 1947)”, the words, figures and brackets “in sub-section (1) of section 13 of the Prevention of Corruption Act, 1988 (Central Act No. 49 of 1988)” shall be substituted.
