THE KARNATAKA HIGHWAYS (AMENDMENT) ACT, 2010

An Act further to amend the Karnataka Highways Act, 1964.
Whereas, it is expedient further to amend the Karnataka Highways Act, 1964 (Karnataka Act 44 of 1964) for the purposes hereinafter appearing;
Be it enacted by the Karnataka State Legislature in the sixty-first year of the Republic of India, as follows:-
1. Short title and commencement.- (1) This Act may be called the Karnataka Highways (Amendment) Act, 2010.
(2) It shall come into force at once.
2. Amendment of section 19A.- In the Karnataka Highways Act, 1964 (Karnataka Act 44 of 1964) (hereinafter referred to as the principal Act), in section 19A,-
(i) after sub-section (3), the following shall be inserted, namely:-
“(3A) Notwithstanding anything contained in section 48A, the Government may levy and collect, such rate of fee from the user of highways for service or benefits rendered by it, as may be notified by it in the official Gazette, different rates may be notified for different highways over different period of time, having regard to the expenditure involved in cost of acquisition of land and construction, development and maintenance of highway developed under public private partnership on annuity basis or by raising any loan or otherwise.”
(ii) in sub-section (4), after the words, brackets and figure “in sub-section (1)”, the words “or State Government” shall be inserted.
3. Amendment of section 19B.- In section 19B of the principal Act, for the words, brackets, figures and letter “in sub-section (1) of section 19A”, the words, brackets, figures and letter “in sub- section(1) and sub-section (3A) of section 19A” shall be substituted.
