An Act to amend certain enactment consequent on the coming into force of the Indian Coinage (Amendment) Act, 1955.



Whereas it is expedient to amend certain enactments consequent on the coming into force of the Indian Coinage (Amendment) Act, 1955 (Central Act 31 of 1955);



Be it enacted in the Eleventh Year of the Republic of India as follows:-



1. Short title and commencement. - (1) This Act may be called the [Tamil Nadu] Coinage (Alteration of References) Act, 1960.



(2) It shall come into force on such [date] as the State Government may, by notification, appoint.



 










Object & Reasons




 










Statement of Objects and Reasons. - According to section 14(3) of the Indian Coinage Act, 1906 (Central Act III of 1906), as amended by the Indian Coinage (Amendment) Act, 1955 (Central Act 31 of 1955), all reference in any enactment to any value expressed in annas and pies shall be construed as references to that value expressed in terms of decimal coins, that is, naya paise, the fractions of which are rounded off to the nearest naya paisa. Many of the enactments in force in the State of Madras have already been amended altering references to annas and pies into references to decimal coins. This Bill seeks to amend certain other enactments for the purpose of altering references to annas and pies into reference to decimal coins. Enactments to which separate and comprehensive amendments are under consideration and enactments which are shortly to be repealed have been excluded from the scope of this Bill.



In some cases, for facilitating calculation and avoiding practical difficulties, the conversion has been indicated in round figures with 5 naye paise or multiples thereof as the basis.






2. Amendment of certain enactments. - The enactments specified in the Schedule are hereby amended to the extent and in the manner mentioned in the fourth column thereof.

In section 19, for the words "two annas for every hundred words", the words "twenty-five naye paise for every two hundred words or part thereof" shall he substituted.

1. In section 71', for the words "twelve annas", the words "seventy-five naye paise" shall be substituted.



2. After section 77-A, the following section shall be inserted, namely:-



"77-B.1 Fees to be computed to the nearest multiple of five naye paise. - In the determination or computation of the amount of fee chargeable under this Act, any fraction of five naye paise less than two and a half naye paise shall be disregarded and any fraction of five naye paise equal to, or exceeding, two and a half naye paise shall be regarded as five naye paise."

The above scale includes all expenses, except in suits where the tenant disputes the landlord's claim, and witnesses have to be sub-poenaed, in which case each subpoena for sums under Rs. 40 shall be paid for at twenty-five naye paise each, and seventy-five naye paise above that amount; and also where peons are kept in charge of property distrained twenty-five naye paise per day shall be paid per man.



4. For the Fourth Schedule the following Schedule shall be substituted, namely:-

5. In the Fifth Schedule-



(i) for the words "Eight annas" and "Twelve annas" wherever they occur,, the words "Fifty naye paise" and "Seventy-five naye paise" shall respectively be substituted;



(ii) for the words "eight annas" wherever they occur,, the words "fifty naye paise" shall be substituted;
