THE KARNATAKA LEGISLATURE SALARIES, PENSIONS AND ALLOWANCES (AMENDMENT) ACT, 2015

An Act further to amend the Karnataka Legislature Salaries, Pensions and Allowances Act, 1956.
Whereas it is expedient further to amend the Karnataka Legislature Salaries, Pensions and Allowances Act, 1956 (Karnataka Act 2 of 1957) for the purposes hereinafter appearing;
Be it enacted by the Karnataka State Legislature in the sixty-sixth year of the Republic of India, as follows:-
1. Short title and commencement.- (1) This Act may be called the Karnataka Legislature Salaries, Pensions and Allowances (Amendment) Act, 2015.
(2) It shall come into force at once.
2. Amendment of section 3.- In the Karnataka Legislature Salaries, Pensions and Allowances Act, 1956 (Karnataka Act 2 of 1957), (hereinafter referred to as the principal Act), in section 3,-
(i) in sub-section (1), for the words "thirty thousand rupees", the words "fifty thousand rupees" and for the words "two lakhs rupees", the words "three lakhs rupees" shall be substituted;
(ii) in sub section (2), for the words "thirty thousand rupees", the words "fifty thousand rupees" and for the words "two lakhs rupees", the words "three lakhs rupees" shall be substituted.
3. Amendment of section 4. - In section 4 of the principal Act,-
(i) in sub-section (1), for the words "forty thousand rupees", the words "eighty thousand rupees" shall be
substituted; and
(ii) for sub-section (2), the following shall be substituted, namely:-
"(2) The Chairman or the Speaker who is entitled to a house rent allowance, shall be entitled for an allowance of twenty thousand rupees per mensem for maintenance and upkeep of the residence and for layout and maintenance of gardens included in such residence."
4. Amendment of section 5.- In section 5 of the principal Act, in sub-section (2), for the words "seven hundred and fifty", the words "one thousand" shall be substituted.
5. Amendment of section 6.- In section 6 of the principal Act, in sub-section (1), in item (a), for the words "seven hundred and fifty", the words "one thousand " shall be substituted.
6. Amendment of section 8.- In section 8 of the principal Act, in sub section (2),-
(i) in item (b), for the words " twenty rupees ", the words "thirty rupees" shall be substituted.
(ii) in item (d), for the words "rupees one thousand", the words "rupees two thousand" shall be substituted.
(iii) in first proviso, for the words "two thousand rupees per day for the days of journey and for the days of halt at any place", the words "two thousand five hundred rupees and five thousand rupees per diem for stay in hotel or other registered establishment providing lodging and boarding at scheduled rates subject to production of bills" shall be substituted.
7. Amendment of section 10.- In section 10 of the principal Act,-
(i) in sub-section (1), for the words "twenty thousand rupees", the words "forty thousand rupees" shall be substituted;
(ii) in sub-section (2), for the words "seven hundred and fifty litres", the words "one thousand litres" shall be substituted.
8. Amendment of section 10A.- In section 10A of the principal Act,-
(i) in sub-section (1), for the words "twenty thousand rupees", the words "forty thousand rupees" shall be substituted.
(ii) in sub-section (2), for the words "twenty thousand rupees", the words "forty thousand rupees" shall be substituted.
9. Amendment of section 10E.- In section 10E of the principal Act, for the words "twenty thousand rupees", the words "forty thousand rupees" shall be substituted.
10. Amendment of section 10G.- In section 10G of the principal Act, in sub-section (2), for the words "seven hundred and fifty litres ", the words "one thousand litres" shall be substituted.
11. Amendment of section 10J.- In section 10J of the principal Act, for the words "twenty thousand rupees", the words "thirty five thousand rupees" shall be substituted.
12. Amendment of section 10K.- In section 10K of the principal Act, for the words "twenty thousand rupees", the words "thirty five thousand rupees" shall be substituted.
13. Amendment of section 10L.- In section 10L of the principal Act, in sub-section (2), for the words "seven hundred and fifty litres", the words "one thousand litres" shall be substituted.
14. Amendment of section 10M.- In section 10M of the principal Act, in sub-section (2), for the words "seven hundred and fifty litres", the words "one thousand litres" shall be substituted.
15. Amendment of section 11.- In section 11 of the principal Act, in sub-section (1), for the words ""twenty thousand rupees", the words "twenty five thousand rupees" shall be substituted.
16. Amendment of section 11A.- In section 11A of the Principal Act, in sub-section (1),-
(a) in clause (iii), for the words " twenty five thousand rupees", the words "forty thousand rupees" shall be substituted;
(b) the first proviso shall be omitted;
(c) in third proviso, after the word "member", the words "elected for the first time" shall be inserted;
(d) after seventh proviso and before Explanation, the following shall be inserted, namely:- "Provided also that where any person has served for more than five years there
shall be paid to him an additional pension at the rate of rupees one thousand per mensem for every subsequent completed year".
17. Amendment of section 11C.- In section 11C of the principal Act,-
(i) in sub-section (1), for the words "one lakh rupees ", the words "two lakhs rupees" shall be substituted.
(ii) in sub-section (2), for the words "one lakh rupees", the words "two lakhs rupees" shall be substituted.
18. Amendment of section 12.- In section 12 of the principal Act,-
(i) for clause (a), the following shall be substituted, namely:-
"(a) there shall be paid to the members of the Legislative Assembly and of the Legislative Council traveling allowance for journeys at the rate of twenty five rupees per kilometre irrespective of mode of journey subject to such conditions as may be prescribed or fixed traveling allowance rupees one thousand five hundred for each meeting in lieu of traveling allowance calculated on the basis of distance traveled in kilometers."
(ii) in clause (b),-
(a) in sub-clause (i), for the words "one thousand rupees", the words "two thousand rupees" and for the words "one thousand five hundred rupees", the words "two thousand five hundred rupees and five thousand rupees per diem for stay in hotel or other registered establishment providing boarding and lodging at scheduled tariffs subject to production of bills and also one thousand five hundred rupees towards local transport " shall be substituted;
(b) after sub-clause (ii), the following shall be inserted, namely:-
"(iii) In respect of study tours abroad the T.A. claims of the members shall be regulated as per G.O.No. FD 3 SRA 2011, dated: 15.11.2011 as amended from time to time."
(iii) in clause (c),-
(a) in sub-clause (iii), for the words "rupees four thousand", the words "rupees five thousand" shall be substituted.
(b) for sub-clause (iv), the following shall be substituted, namely:-
"(iv) Every person who is drawing family pension under section 11B shall be entitled to rupees two thousand five hundred per month as fixed medical allowance."
(iv) in clause (cc), for the words "rupees twenty five thousand" the words "rupees forty thousand" shall be substituted.
(v) in clause (e), in sub-clause (iii), after the words "at the rates specified in clause (a)", the words "and for journeys by air within the state and outside the state in India actual air fare shall be paid" shall be inserted.
(vi) in clause (h),
(a) in sub-clause (i), for the words "fifteen thousand rupees", the words "twenty thousand rupees" shall be substituted.
(b) in sub-clause (ii), for the words "fifteen thousand rupees", the words "forty thousand rupees" shall be substituted.
