TAMIL NADU FAMINE RELIEF FUND ACT, 1936



(Tamil Nadu Act 16 of 1936)



Received the assent of the Governor on the 17th September 1936, and that of the Governor-General on the 2nd October 1936. The assent of the Governor-General was first published in the Fort St. George Gazette on the 8th October 1936.



An Act to provide for the establishment and maintenance in the [State of Tamil Nadu] of a Fund, called the [Tamil Nadu Famine Relief Fund], for utilization on occasions of serious famine and of distress caused by serious drought, flood or other natural calamities in the said [State].



Whereas it is expedient to provide for the establishment and maintenance in the [State of Tamil Nadu] of a fund for utilization on occasions of serious famine and of distress caused by serious drought, flood or other natural calamities in the said [State];

It is hereby enacted as follows: -



1. Short title, extent and commencement. - (1) This Act may be called the [Tamil Nadu] Famine Relief Fund Act, 1936.



(2) It extends to the whole of the [State of Tamil Nadu],



(3) (a) This section shall come into force at once.



(b) The remaining provisions of this Act shall come into force on such date as the [State Government] may, by notification in the [Official Gazette], appoint.



This Act came into force on the 8th October 1936. This Act was extended to the merged State of Pudukkottai by section 3 of, and the First Schedule to, the Tamil Nadu Merged States (Laws) Act, 1949 (Tamil Nadu Act XXXV of 1949). This Act was extended to the Kanyakumari district and the Shencottah taluk of the Tirunelveli district by section 3 of, and the Schedule to, the Tamil Nadu (Transferred Territory) Extension of Laws Act, 1957 (Tamil Nadu Act XXII of 1957). This Act as amended by sub-section (2) of section 11 of the Tamil Nadu (Added Territories) Extension of Laws Act, 1964 (Tamil Nadu Act 8 of 1964) was extended to the added territories by sub-section (1) of section 11 thereof.



2. Definition. - In this Act, 'Fund' means the [Tamil Nadu Famine Relief Fund] established under section 3.



3. Establishment of the [Tamil Nadu Famine Relief Fund]. - [The State Government shall establish in and for the [State of Tamil Nadu], a fund called "The [Tamil Nadu Famine Relief Fund] ."] The Fund shall consist of -

(iii) such [***] sums as the [State Government] may, from time to time, contribute to the Fund under sub-section (2) of section 7 or otherwise; and



(iv) the interest which may, from time to time, accrue on [the securities of the Central or of the [State] Government] in which the sums to the credit of the Fund may be invested or re-invested under section 6.



4. [This section was omitted by section 11 (2) (in) of the Tamil Nadu (Added Territories) Extension of Laws Act, 1964 (Tamil Nadu Act 8 of 1964).]



5. Purposes for which the Fund may be utilized. - The Fund shall not be expended except upon -



(i) the relief of serious famine in the [State of Tamil Nadu]; and



(ii) the relief of distress caused by serious drought, flood or other natural calamities in the said [State]:



Provided that when the Fund exceeds forty lakhs of rupees, the [State Government] may utilize the excess to meet expenditure on protective irrigation works and other works for the prevention of famine in the said [State].



6. Investment and reinvestment of amount not required. - The [State Government] shall, from time to time, invest or re-invest in [the securities of the Central or of the [State] Government] all sums to the credit of the Fund, which may not be immediately required for any of the purposes mentioned in section 5.



7. Accounts of the Fund and making up of the deficiency in the Fund. - (1) The accounts of the Fund shall be made up at the end of each financial year, the securities belonging to the Fund being valued at their market value on the last day of such year.



(2) If the accounts so made up show that the balance in the Fund at the end of such year falls short of sixty lakhs of rupees, the deficiency shall be made up from the revenues of the [State]:



Provided that if the deficiency exceeds five lakhs of rupees, it may be made up in annual instalments, the amount of each instalment except the last being not less than five lakhs of rupees.



[(3) All sums payable to the Fund under sub-section (2) shall be expenditure [charged on the Consolidated Fund of the State].]
